On Dec. 16, 2020, then-Director James McHenry of the Executive Office for Immigration Review (“EOIR”) issued a final rule making sweeping changes to the procedures governing the immigration court.These changes are so drastic that it has destroyed any semblance of due process...1 When DHS seeks to have a noncitizen ordered removed under 8 U.S.C. § 1229a, non-citizens are entitled to be represented, at no expense to the Government. Their counsel has a right to examine evidence against the alien & to present evidence on the alien’s own behalf....2

Federal Judge orders full restart of DACA program - The restart won’t be immediate. U.S. District Judge John Bates said the order would be delayed until Aug. 23 to allow the government to appeal. apple.news/ADbtC1iiDTMOLC… In a 25-page opinion Friday, Bates, an appointee of former President George W. While a lot of focus is on families separated, & rightfully so; there is a whole lot happening in other arenas in immigration. In Texas, those who file to become US Citizens have to wait 18 months to get an interview. The wait is the longest & prevents new citizens from voting. This is a powerful read: "The Refugee Act was adopted against the background of the Holocaust, in which the US took only a tiny handful of refugees from the Nazis, leaving untold numbers to perish at their hands. Lilian Martinez is my client. She is an asylum seeker from Guatemala. She was released by ICE, but her 5 yr old son is detained at Bokenkamp in Corpus Christi, TX. She hasn’t seen her son since May. I am going to explain in summary how one surrenders themself at the U.S. Border to request Asylum. The “border” can be at an airport or any other U.S. port of entry. Upon arrival at the port of entry the Asylum seeker surrenders themself to a Customs & Border Protection Officer.. ...At that point CBP books the person, takes their fingerprints, & performs a short question and answer with the Asylum seeker. A report is populated on the Asylum seeker. That report is called an I-213....
