Important new decision from National Labor Relations Board that affects the rights of the 100 laid off Twitter workers I represent plus many other workers!

The severance agreement Elon Musk and Twitter offered workers last month is ILLEGAL under this decision.

Here's why. NLRA Sec. 7 strongly protects rights of workers to discuss terms and conditions of employment with coworkers.

Though NLRB often enforces these rights for union workers, you do NOT have to be in a union to have these rights. EVERYONE has the right to engage in concerted activity.

Prince Andrew reportedly asking his legal team to find a way to undo his sex abuse settlement.

Here's why chances of that are somewhere between zero and not a chance.

Twitter workers, many of whom I represent, were FINALLY given their "severance agreements" on Saturday.

They are really settlement agreements which SILENCE WORKERS FOR LIFE and and require them to give up important legal rights.

Let's discuss. 1/ First, any worker who wants to bring a claim, for Twitter's broken promises, discrimination, fraud etc. (the claims we are filing), SIGNS AWAY THE RIGHT TO SUE FOREVER under this agreement.

No lawsuit, no arbitration if you sign.

So it's really a settlement agreement. 2/

Here’s how this could work for Twitter workers facing “opt in or be fired” choice today.

His promises there are important and legally enforceable by laid off folks. Here's why. Part of what Elon promises when buying Twitter was that workers laid off post-Elon would get no worse compensation and benefits than workers laid off pre-Elon.

Hey Twitter employees getting laid off tomorrow! IMPORTANT INFO from a CA employment attorney (me):

CA's "WARN" law requires Twitter to give you 60 days notice of a massive layoff.

A layoff of 50+ employees within a 30 day period qualifies.

I know you didn't get that notice. This WARN law applies to all California employers of 75+ employees, which obviously includes Twitter with its thousands of employees.

Purpose of the law is to give laid off employees time to figure out how to handle this disruption.

And Elon completely ignores it.

Reading the judge's 46 page decision rejecting Prince Andrew's attempt to throw out Virginia Giuffre's case now.

A detailed, well reasoned decision.

Noteworthy: Judge Kaplan is keenly aware "the lay public" will be reading this, so he takes pains to spell out the law clearly. As Judge Kaplan says, his obligation now is to assume all of Virginia's facts in her complaint are true -- though later the jury will decide those facts. For now, the only question is whether Prince Andrew had grounds to get her case dismissed.

Decision: nope, he does not.

LIVE now: Prince Andrew’s attorney is arguing that Virginia Giuffre’s case against him should be dismissed due to a 2009 settlement agreement in which she released all “potential defendants.”

Judge Kaplan aggressively questioning him about the law on this.

I’m listening in. Prince Andrew's attorney is now arguing that Virginia's complaint is too vague as it does not include the dates she says she was abused by him. Only says she was 17 at the time.

Virginia Giuffre's settlement agreement with Jeffrey Epstein was released today. Prince Andrew argues that her settlement with Epstein releases him as well, and therefore her case against him should be dismissed.

Here's why he is wrong Virginia's settlement agreement includes truly unusual and bizarre language that I would never allow in a settlement agreement: that claims against "any other person or entity who could have been included as a potential defendant" is also released.

10. There were pictures of topless girls, taken by amateur photographer Ghislaine, adorning her desk.

(And throughout Epstein’s revolting homes.) 9. Defense gets likeable maintenance man to admit he sometimes, when instructed, scheduled massages, paid the girls, drove Ghislaine to find girls to give massages, then:

Testifying now in the Ghislaine Maxwell trial is Dr. Lisa Rocchio, an expert explaining grooming, delayed reporting, and the lifelong impacts of child sexual abuse. Important stuff to undermine all of the myths the defense wants to argue in this and every case. For example, the fact that a victim did not report child sexual abuse until many years later is very common. That only happens in adulthood when they have a relationship of trust with a friend or therapist.

I have seen this in so many of my cases over the last 30 years.

BREAKING: Just heard defense opening statement here at Ghislaine Maxwell trial. An appalling, fawning love letter to Jeffrey Epstein, a “charming” “21st century James Bond.”

Bond fights the bad guys. Epstein WAS the bad guy.

Are you as surprised as I am by this strategy? Prosecution's opening was masterful storytelling: Jane, 14, met a man and woman at her summer camp. They lured her with scholarship promises. The man and woman were Jeffrey Epstein and Ghislaine Maxwell. 3 more underage girls will tell a similar story.

I notice that "quarantine" is interpreted many ways. I've been hounding my loved ones to practice EXTREME quarantining. Stay home, period. Order in groceries no more thatn once every two weeks. Outside, remove outer box and put in trash. It never comes in. 1/ Take items inside w/o touching anything on the way in. Put in sink and wash thoroughly with soap and hot water or wipes. Should take about an hour. Put on loud music and do it, no excuses. Wash hands thoroughly.
No takeout. No "just seeing this one friend." No housekeeper. 2/

Just finished reading every word of Jeffrey Epstein indictment. Three anonymous victims are included, who were underage girls 2002-5. "As young as 14." He's alleged to have used other minor victims to lure them to his Manhattan penthouse. documentcloud.org/documents/6184… Three unnamed employees are named as assisting Epstein in setting up the naked massage sessions that turned into sexual assault. (Reminder: all sex with an underaged person is a SEXUAL ASSAULT, not sex.)
