I'm increasingly worried by the number of undocumented people I'm seeing who need to make late applications to the EU Settlement Scheme. /1 Significant numbers involving people eligible for settled status in the UK - some resident in the UK for a decade. Many have already applied and failed at the first hurdle because of language/IT/misunderstanding. Some involving entire families who are undocumented. /2

The Guidance on Extended Family Members and issuing of permits has been updated.

It is not great news.

It's not entirely clear, but it appears that they will be revisiting decisions even those that have already been decided by judges! /1 assets.publishing.service.gov.uk/government/upl… Why is this bad?

Well it is more wait and pain for the families impacted.

Some have now been waiting well over a year and some situations are desperate. I'm aware of hundreds of cases.

Today the Commons will debate regulations that will essentially tip those who have not yet acquired their EUSS status into the Hostile Environment from 1 July 21. Some thoughts: /1 The regs. are legion. Covering nearly every aspect of the Hostile Environment. These regs have been made using Henry VIII powers. They perfectly illustrate the problem with this power. A single debate on all clauses with no opportunity to amend is not good democracy. /2

The Home Office have produced a document hitting back at the criticism levelled against EUSS (the scheme most EU citizens must apply under to remain in the UK after Brexit). A few points on the objections to a declaratory style system: /1 Many have made clear that the consequences of forcing people to apply to stay in the UK will lead to people missing out on acquiring status.
