Human rights cannot be applied selectively. The UK has binding obligations under the Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW) to uphold women’s sex-based rights and ensure their safety, privacy, and dignity. 🧵 Yet this cornerstone of international law is entirely absent from the Commissioner’s analysis.

The Supreme Court makes clear that in the context of the Equality Act, sex means biological sex. That is now settled law, and as lawmakers and public servants, we have a duty to respect and uphold it. 🧵 The Court’s role is not to reflect on people’s feelings or politics. It is to interpret the law as written. What, it has reaffirmed is the legal right for women, meaning biological females to access single sex spaces and services, where privacy, safety or fairness are essential.
