Students of jurisprudence would be aware of the Hart Fuller debate regarding validity of bad laws/orders and the contradiction between obedience to commands and one’s own conscience. In light of the IG Sindh’s letter (and subsequent retraction, pending inquiry) here’s a summary. In his essay, “The Separation of Laws and Morals,” jurist H.L.A Hart says that when law is passed and ostensibly comes from a chain of command, it is valid and there’s a distinction between an invalid law and one that’s too evil to be obeyed.

These Ulemas are ignorant of Pakistan’s colonial laws which are totally incompatible with Islamic finance. In foreign states like Malaysia, assets which are sold are not subject to Government duties and they also accept rudimentary security such as jewellery as collateral. So you have a parallel banking system in place that “believers” accept as halal but has actually been demonised by Taqi Usmani in his own judgment as a sham.

So PM Imran Khan has once again resurrected talks about abolishing the British system and resurrecting Iqbaliaat as the lightening rod of philosophical and religious teaching across schools in Pakistan.
