Yesterday, the district court hearing the Middle East Studies Association's and the AAUP's suit against the Trump Administration's policy to deport non-citizens who engage in criticism of Israel denied the government's motion to dismiss the suit, a small but important win. Just finished listening to part I of this hearing. The judge, a George HW Bush appointee, is clearly sympathetic to the plaintiffs, even as he understands that the law is not likely to support a judicial intervention (1/5). @Heidi__Matthews @BhabhaFaisaluscourts.gov/cameras-courts… Another important point: the judge repeatedly emphasized how important and weighty this case is, and he made repeated references to the ICJ decision in this part of the hearing which was devoted to technical questions of federal jurisdiction and the separation of powers.
