Islamist Antisemitism: A Neglected Hate

This is a must read report for any Jew in the UK and anyone interested in the dangers of Islamic antisemitism anywhere in the word.

I provide most of the executive summary in the following tweets [sometimes with comments in square brackets] and ending with a link to the report.

Tl;Dr Islamic antisemitism has not been recognised as a distinct form of antisemitism in the relevant institutions and it most definitely should be and urgently. The Independent Review of Prevent by Sir William Shawcross observes that many individuals of radicalisation concern appear to harbour antisemitic beliefs, in some cases expressing the intent to assault and kill members of the Jewish community. The Review consequently recommends that Prevent begin to address the anti-Jewish component of both Islamist and Extreme Right-Wing ideology. [but not Far-left ideology?]

The brilliant Natasha Hausdorff of @uklfi has presented an important and highly informative seminar on the troubling case brought by the South African Government against Israel in the International Court of Justice, which is the court that binds UN state members (as opposed to the International Criminal Court #ICC which only addresses individuals not states and, to which the USA, Israel and others are not signatories).

She defines #LawFare as the abuse of legal processes for political ends. She continues to argue that both the #UN General Assembly advisory request and the SA Government case to the #ICJ are examples of this, in different ways.

She starts by giving a concise summary of the #UnitedNations historical anti-Israel bias which unfavourably reflects on the UN General Assembly request for an Advisory (non-legally binding) Opinion on the conflict. She gives all the key important statistics unequivocally demonstrating the bias, that should be obvious to any unbiased observer and is very useful hear in such a compact and efficient manner.

Her analysis of the #ICJ's previous judgements, specifically the infamous Wall Judgement, shows it was significantly biased by the grave omission of clearly relevant evidence - the military security and civilian safety justifications for the security wall - and, thus, brings into question the impartiality of the court and hence the credibility of this court. That is the Lawfare of this kind undermines the rule of international law not just for Israel but for the world as a whole - a point she continues develop throughout this seminar.

Addressing the case brought by the SA Government against Israel accusing it of #Genocide against #Gaza citizens. she lists a number of points on how poor the case presented is.

1. The internationally agreed definitions of Genocide, as in the Genocide conventions, unequivocally shows the the requirement for intent - mens rea - applies to Hamas and does not apply to Israel.

The intent must be specifically of genocidal intent and if there are alternative explanations, these must be taken into consideration to establish sole intent - and all that evidence is omitted from the SA case.

Evidence such as:
▶️the stated goal to prevent a genocidal organisation from committing further genocides - to which all parties in the Genocidal conventions are obliged to respond to and gives Israel a legal basis for its actions.
▶️ the various early warnings measures provided to Gaza citizens
▶️ the stated and official intent to eliminate Hamas's operational capacity to commit genocide.
▶️ self defence - to protect and keep its Israel's citizens safe from harm

This and other supporting evidence is omitted from the case

2. It further omits all the harms caused by Hamas directly and indirectly against its own citizens such as:
▶️targeting its own civilians
▶️accidental deaths and injuries due to misfiring missiles fired by Hamas and associate organisations
▶️the locating of military installations in civilian areas and buildings
▶️other uses of human shields by Hamas

This and other supporting evidence is omitted from the case

3. The dubious provenance of arguments and evidence provided by suspect UN organisations and HR NGOs included in the submissions

4. That the set of statements provided by Israeli officials are

▶️often missing context i.e. they are addressing Hamas and not Gazan civilians
▶️ significance or authority - that is is this official policy or personal opinion?
▶️ mis-quotes
▶️ false quotes - including one of a non-existent (made up) MK provided by that highly reliable sources (sarcasm) the Middle Eastern Eye
▶️the omission of any official statements of intent by the Israeli Government

5. The lack of any analysis of proportionality
▶️As I have repeatedly said, the civilian to combat ration in this conflict is 2:1
▶️ this compares very favourably with the Allies in the Afghanistan and Iraq conflict of 4 to 5:1
▶️ and in general in post WW2 wars of 9:1

There is much more in her seminar which I thoroughly recommend you watch. The above is a mere precis of some very informative content.

One thing I have omitted is that I think - she does not argue this but she does provide the relevant legal points - that Israel could make a counter-claim against South Africa. In my view this case itself is evidence of SA Government support for terrorism, genocide and Hamas in particular. In this light, she does not mention the mirror politics propaganda method of indirect (some lawyers argue it is direct) incitement to genocide, which - I am not a lawyer IANAL - strengthens a counter-claim against the SA Government.
