(🧵 1/16) Professor @Jed_Rubenfeld recently argued that the Trump administration’s visa actions against @Harvard are illegal retaliation.

We respect Rubenfeld immensely. He’s a principled scholar and a defender of civil liberties. But here, he’s wrong.

1. Rubenfeld’s legal argument is not bulletproof.

2. Even if it were right, legal victory is irrelevant.

3. People need to stop thinking like litigators and start thinking like strategists.

We heartily agree with her. Columbia's Statutes are very important.
