Congress is making hue and cry about Income Tax action and notices since last few days.

Today morning they did a press conference on the same.

Let's see and understand the facts 1) AY 2018-19:
On 06.07.2021, Assessment order of AY 2018-19 was passed creating a demand of Rs. 105.17 crores. The Congress, as assessee, failed to pay the demand.

Against the assessment order, the Congress preferred an appeal before CIT(Appeal).

Stay application of Congress filed was dismissed through speaking order. Further, notice of recovery was served on the them.

Later, appeal of Congress was dismissed by Ld. CIT(Appeal) on 28.03.2023. Congress preferred an appeal before Hon’ble ITAT.

Accordingly, to recover outstanding demand, measures were undertaken to recover demand of around Rs. 135 Crores (Tax + Interest).

In the meanwhile, Congress filed stay application with Hon’ble ITAT. During the stay proceedings, the recovery measures were halted.

Subsequently, Hon’ble ITAT dismissed the stay petition, after discussing the issues on merits.

Against the said order, INC approached Hon’ble Delhi High Court, which dismissed the appeal of the assessee on 13.03.2024, with adverse remarks.

Everybody is talking about Ms Mahua Moitra sharing the credentials of her MP portal with Mr Hiranandani.

And it is alleged Mr Hiranandani used the credentials to frame the questions targeting Mr Adani & his cos.

But one of the important point is missed.
