First - it wasn’t secret. There was an OIC and a Customs Notice during the writ - even before early voting. How do I know? /1 Because we blogged about it on April 17:

I had been wanting to tweet about this, but didn't necessarily want to amplify the wrong voices, so I'll repost David's good point instead and then add an additional thought.

This is more than not a serious story - this is significantly damaging to our civil society. /1 This project does serious work in finding potential futures that have undesirable outcomes, and then charting a course for: 1) avoiding it, and 2) coming up with plans to mitigate the impacts of it if it happens. Rather than coming as a surprise, we can cushion a blow. /2

While I have other issues with s. 33, the biggest issue I have with @GeoffSigalet’s piece is the second myth. There are several reasons for this. The first is a matter of statutory construction. I’ve posted below the relevant portion of s. 33 and s. 1…/1 It’s important to consider these provisions together as both directly engage with the limitation of rights under the charter. Section 1 makes clear rights are guaranteed subject to reasonable limits as recognized by free and democratic societies. /2

So I didn't think I'd have to do this, but because an MP is tweeting out nonsense that they should, or reasonably should, know is both wrong and inflammatory for partisan gain, I have no choice.

The "Liberal Government" isn't taking the Speaker to court for "doing his job". /1 The AG's office (which is independent from the whims of the PMO/GiC) is acting under a statutory requirement of the Canada Evidence Act ("CEA").
