The U.S. Department of Justice sued Troy, Idaho, alleging the city violated the Religious Land Use and Institutionalized Persons Act (RLUIPA) by denying Christ Church’s application to operate a religious assembly in a downtown business district.
RLUIPA protects religious institutions from discriminatory zoning laws. The DOJ claims Troy’s denial of Christ Church’s conditional use permit (CUP) violated RLUIPA by treating religious assemblies worse than nonreligious ones and burdening religious exercise.
