Canon Law clearly demonstrates that POPE Benedict's renunciation of ministry cannot be sustained as a renunciation of munus, because in canon 40 it is clearly said that the munus is that which is executed in an administrative act, and in canon 41 the execution is called ministry! Hence Cardinal Sodano, as Dean of the College of Cardinals, violated canon 41 in calling a Conclave in Feb 2012, because both canons 40 and 41 make it quite clear that Benedict's renunciation was invalid to effect a loss of munus for renouncing the ministerium, as per canon 188.

Yes it does, but the discernment of each sin as a canonical crime differs, because 1 is principally in exterior acts, the other is in the intellect. Neither require a sentence, but heresy requires investigation.
