In 2019 when Mashaba resigned from the DA as Mayor of the COJ he said,
"I have had to deal with people who did not want me to implement the insourcing program that has benefitted over 7000 families and contained contractual costs, merely because it was not a DA policy"

⬇️🔴In my analyses of the GF committed grants data base a week ago I shared that the African Union Development Agency - New Partnership for Africa’s Development (AUDA-NEPAD) based in Gauteng had received substantial funding (R897million) and referred to a history of a planned future of for medicine regulation in Africa, the African Medicines Agency (AMA) and subsequent to this the analyses of the AMA Treaty tabled at Parliament and yet to be approved.

The Gates Foundation announcement for the stated purpose of the 100 million euros:
❗️To strengthen regulatory capacity to improve health security in Africa, including through the expansion of local manufacturing of quality, safe, efficacious, and affordable medicines, vaccines, and other health tools.
❗️To foster collaboration and sharing of technical expertise between the EMA and the AMA and support several African national regulatory authorities (NRAs).
- The EU will support the AMA with a comprehensive package of actions to strengthen its capacity, alongside regional and national initiatives to strengthen regulatory capacity in countries such as Rwanda, South Africa, Ghana, and Senegal, together with France, Germany, and Belgium.
- The Bill & Melinda Gates Foundation is likewise providing funding towards the AMA, the regional economic communities (RECs), and certain NRAs, as well as to various technical partners.

👋📕The Gates Foundation (GF) has committed BILLIONS in grants to various institutions primarily focusing on Global Health, Development, Policy & Advocacy, and gender equality:

1⃣ South Africa received $910 million (R13.3 trillion) between 2008 and 2023, with $581 million committed during the period from 2008 to 2023.

2⃣ The African Region received $28 billion from 1997 to 2023, with $9.8 billion committed from 2018 and 2023.

3⃣ The World Health Organization (WHO) received $5.1 billion from 1998 to 2023.

❗️South Africa is among the top 5 countries receiving grants, having obtained 507 grants. India is the 4th highest recipient with 748 grants, Switzerland with 910, the UK with 1388, and the USA with the most, 26,988 grants.

🔖📕Approval Process of the AMA Treaty ❗️🇿🇦

❗️Did you know that it is a constitutional requirement that all international agreements have to be tables in Parliament, and that those falling within the ambit of section 231(2) of the Constitution requires tabling and approval of the National Assembly (NA) and the National Coincil of Provinces (NCOP)?

‼️But, why is there pressure that the NA approves the Treaty when we see no official record of the AMA treaty tabled for approval with the NCOP?‼️

History of the NCOP Oversight function:
- An earlier interim report on the request of the then chair of The NCOP, Dr. Naledi Pandor, on its role in the oversight process provides that it is to assess whether the implementation of laws and the expenditure of funds achieves the goals intended by Parliament, and that transformation will occur only to the extent that initial goals are attained.
- Poor implementation will prevent, or at least, delay transformation. The NCOP’s role in oversight is to draw provincial and local experience into the national debate when the effectiveness of policy and its implementation is considered.
- The report suggests that the NCOP has a great degree of flexibility in the way in which it fulfils its oversight role.
- Although it is constitutionally obliged to conduct certain oversight functions it can be selective.
- This allows the NCOP to prioritise important issues and review them thoroughly rather than covering a great amount of ground superficially.
- The NCOP is a small house with limited capacity but in choosing matters to focus on, the NCOP might, it can
• Respond to specific needs or problems that have been brought to its attention; or
• Review areas in which legislation is in place and has been implemented, to assess whether the policy is successful and any glitches need to be sorted out.

The AMA Treaty approval:
The AMA Treaty when approved binds the Republic only after it has been approved by resolution in both the NA and the NCOP.

Note for the AMA Treaty
International agreements requiring parliamentary approval in terms of Section 231(2) of the Constitution are agreements that:
1. Have financial implications that require an additional budgetary allocation from Parliament.
2. Have legislative or domestic legal implications (e.g. require new legislation or legislative amendments)
3. That requires ratification in terms of the international agreement itself.
4. That requires accession in terms of the international agreement itself.
5. Are not departmentally specific but straddle the functions of more than one line-function department. 6. Have major political or other significance.

👋📕The African Medicines Agency (AMA) Treaty:

🇿🇦What South Africans urgently need to be informed about is Parliament's failure to address crucial details regarding the AMA Treaty at the Portfolio Committee meeting held on 14 Nov 2023. In my view, Parliament should refrain from ratifying the AMA Treaty until the public participation process is incorporated, and essential questions are thoroughly addressed. This lack of transparency denies citizens the right to be adequately informed and involved in decisions that profoundly impact their healthcare and rights.

1. AMA has been in the making since 2009 and it hasn't yet been approved by Parliament, but it is approved by Cabinet. There has been NO public hearings/ public participation & there are far reaching legal implications. But, some organisations are urging that it must be signed, and they are mutually affiliated, some through funding from the Gates Foundation (GF). Eg. SAHPRA, Bhekisisa, WHO, AMATA, Bill Gates, EU, EMA, SAHTAC.
❗️COMMENT - Links in comments which shows a network of some South African institutions receiving grants from the GF & working with global partners who advocate for the implementation of the AMA in Africa dating back a few years.

2. Once approved by Parliament it is binding on the Republic in terms of section 231(2) of the constitution and South Africa will give up our rights to make informed decisions on ALL our healthcare decisions to the AMA which WILL REGULATE (MAKE LAWS) on ALL our food supplements, medical devices, medical products, medicines, traditional medicines, and other regulated products complementary medicines, traditional medical products, cosmetics, food supplements and related products.
❗️Is this why SAHPRA is pursuing regulating our vitamins? How do traditional healers feel about this? How do you feel about this?
- The Parliamentary Committee failed to deliberate on this matter pertaining to health as stipulated in the South African Constitution. How can they justify making a decision to relinquish our constitutional right to healthcare without addressing this specific section in the treaty
- The Committee's oversight in safeguarding South Africans' interests is evident in its failure to thoroughly examine the regulations and provisions regarding compulsory medical treatment. Additionally, it overlooked addressing the provisions concerning claims for individuals suffering from side effects resulting from medical treatments.

3. The ABSENCE of specific definitions for terms such as disease, illness, sickness, disability, or virus within the AMA Treaty raises significant questions regarding the determination of conditions that necessitate treatment:
❗️How does the AMA intend to discern which diseases, illnesses, viruses, or disabilities warrant treatment without defined parameters?
- Without clear definitions, what criteria or guidelines will the AMA use to identify and prioritize conditions requiring medical attention or intervention?
- How will the absence of these specific definitions impact the AMA's decision-making process regarding healthcare priorities and allocation of resources?

4. The NDoh presentation to Parliament on 14 Nov 2023 ommitted discussions on crucial sections of the Treaty:

4.1 The AMA Treaty states that AMA will adhere to the principle of confidentiality.
❗️ What's the extent of the confidentiality and its impact on human rights? Remember the Covid-19 Vaccine Contracts which was withheld from the public? @HealthJusticeIn @ShabnamPalesaMo

4.2 Medical Device means instrument, apparatus, implant, in vitro or calibrator, software….Intended by the manufacturer to be used alone or in combination for humans or animals for:
- Diagnosis, prevention, monitoring, treatment, alleviation of disease
- Investigation, replacement, modification or support of anatomy or of physiological process
- Providing information for medical ...
❗️The Parliamentary committee failed to interrogate what software

The AMA Treaty defines Medicines to be manufactured to use in:
(a) the diagnosis, treatment, mitigation, modification, or prevention of disease abonormal physical or mental state or the symptoms thereof in humans; OR
(b) restoring, correcting or modifying any somatic or psychic or organic function in humans, and includes veterinary medicines
❗️Does this encompass our pets or animal products consumed for human consumption?
- The Parliamentary Committee neglected to address point (b).
- There was a failure to consult independent healthcare experts regarding the interpretation of "correcting or modifying function in humans."
- Does this imply laws permitting children to make decisions without parental consent for undergoing sex changes, and from what age?
- Does it imply the enforcement of laws allowing modifications of human functions against individuals' wills?

4.3 The Functions of AMA (Article 6)

4.5 Article 30: Relationships with other organisations and institutions
- The AMA shall establish and maintain a close working relationship & collaboration with the ff:
(a) World Health Organisation (WHO)
(b) Africa Centres for Disease Control and Prevention (Africa CDC)
(c) Regional Economic Communities (RECs)
(d) Any other UN Agencies, inter governmental organisations and non-govt org or other institutions.
❗️Why did the Parliamentary Committee not scrutinize this extensive section in the treaty?
- Will this collaboration encompass entities like the International Federation of Pharmaceutical Manufacturers & Associations (IFPMA), Bill Gates, or other comparable organizations like Pharmaceutical Manufacturers?
- The omission of an inquiry into the scope and implications of these broad collaborations remains a significant concern.

4.6 That the IFPMA is a founding member of the African Medicines Agency Treaty Alliance (AMATA), which was specifically set up to advocate for the rapid ratification & implementation of the African Medicines Agency Treaty (AMA), and the IFPMA President and Chair of the IFPMA CEO Steering Committee is Albert Boula who is the Chairman and CEO of Pfizer.
❗️The presence of the International Federation of Pharmaceutical Manufacturers & Associations (IFPMA) as a founding member of the African Medicines Agency Treaty Alliance (AMATA), aimed at advocating for the swift ratification and implementation of the African Medicines Agency Treaty (AMA), raises crucial concerns:
- The Parliamentary Committee failed to address or inquire about the potential conflict of interest between IFPMA's advocacy for rapid ratification and the interests of its members, including Albert Bourla, the Chairman and CEO of Pfizer, who holds key positions within IFPMA.
- What level of influence does the IFPMA wield within the AMA framework?
- The potential conflict of interest arising from the close association between key pharmaceutical figures and the advocacy for rapid ratification and implementation of the AMA Treaty should have been thoroughly investigated and disclosed by the Parliamentary Committee.
