1. LAW ON EVICTION IN ZIMBABWE
THE STARTING POINT
Section 74 of the national Constitution guarantees freedom from arbitrary eviction. It is couched in the following manner:

“No person may be evicted from their home, or have their home demolished, without an order of Court made after considering all the relevant circumstances”.

Note that the word “home” has a broad meaning. It doesn’t only connote ownership in the strictest legal sense and protect home owners only but encompasses those with rights of occupation over a property such as tenants/employees who might have rights of occupation over the property through a tenancy or employment relationship as the case may be. The property where the tenant/employee will be occupying becomes their “home” and therefore they can benefit from the protection accorded by section 74 of the Constitution.
Image 2. What is clear is that section 74 of the Constitution places an obligation on the person seeking eviction to follow due process by obtaining a court order first. Home owners are therefore proscribed from taking the law into their own hands and evict tenants as this breeds anarchy.

Spouses can unilaterally dispose of individually owned assets. They are not liable for each other’s debts except for those that are acquired jointly or contracted for household necessities.

HOW DOES ONE GET DIVORCED?
Divorce proceedings are initiated by way of Summons. 2. Attached to the Summons will be a Declaration which is a written statement amplifying the Plaintiff’s claim. The Declaration inter alia sets out the names of the parties, basis upon which jurisdiction is pleaded, grounds for divorce & the ancillary relief sought.
