The display of a "stop the steal" symbol outside Justice Alito's home in January 2021 is a clear ethics violation but also much more than that. A Supreme Court justice appears to have embraced election denialism. That's a five-alarm fire. /1 nytimes.com/2024/05/16/us/… To start, while Alito issued a statement saying that he had "no involvement" flying the flag (and placing the blame on his wife), he *didn't* say he was unaware it was flying outside his house or apologize or disavow it. /2

By all accounts CJ Roberts hasn't joined the majority here. This draft opinion is a stark example of how a 6-3 supermajority is enabling the radicalization of SCOTUS. /1 politico.com/news/2022/05/0… This outcome has long been the goal of the conservative legal movement, but death to Roe by a thousand cuts had always seemed more likely. Yesterday the Ohio Supreme Court struck down the state’s extremely gerrymandered General Assembly maps. I’m still giddy about our clients’ win so I’m going to talk about the promise of state constitutions!! /1 As you may know, the US Supreme Court ruled in Rucho v Common Cause that federal courts can’t hear partisan gerrymandering claims under the US Constitution. But they made clear that state courts, interpreting state constitutions, don’t have to follow SCOTUS’s lead. /2
