From the past two days, I've been seeing a surprising amount of legal misinformation floating around, including from lawyers, about the Government's promise to "withdraw FIRs" registered during the CJP protests. here's a short thread 🧵- The Government has promised to "withdraw all FIRs." Sounds great politically. There's only one tiny problem. Indian criminal law doesn't actually permit the withdrawal of an FIR. The promise is legally impossible in the form it is being advertised.

Outragers on the internet have opinions on everything and knowledge of nothing.

The latest outrage about the Supreme Court saying the “right to vote is not a fundamental right” is exactly that. Noise without legal understanding.

Let’s fix that. Thread 🧵 Lets start with the Constitution.

The right to vote comes from Article 326 of the Constitution of India. It provides for universal adult suffrage. But crucially, it is NOT placed in Part III (Fundamental Rights) Chapter.

This was a conscious decision.

Since a lot of people have commented, allow me to explain my response to the question - Can a live-in partner claim maintenance under Section 125 CrPC ?

My answer to it is - No.

Reasons are as follows - At the outset let's distinguish four things -
1) A valid marriage
2) A void Marriage
3) A marriage that could not be proved
4) A live in Relationship

Let's also distinguish two laws -
1) CrPC gives maintenance to 'Wife'
2) DV Act to relationship in the “nature of marriage”.

Let me tell u a story from not long ago, but 2022. 3 years ago a man named Komal Lodha was accused of Raping, Sodomising and Murdering a 7 year old minor.

The Trial Court found him Guilty and Sentenced him to Death.

The High Court found him Guilty but changed Death into Life Imprisonment.
