Have obtained a really interesting email from James Hamilton (the former IA on the MC) and the SG. For context, I have previously obtained WhatsApps between Mr Hamilton and his Secretariat during the Hamilton Investigation. In which he said the day after the report's publication: Image I found this a rather odd, put simply, why were people telling Mr Hamilton how "pleased" they were with his report and who were they? Remember, the SG is very keen to stress the Independence of the Independence Advisors. As you do, you work the information and ask for more.

My biggest take-away from today is the very clear possibility that the SG has not complied with a prior @FOIScotland decision notice (). Need to have a full look over my notes/re-watch parts of the hearing, but my initial thoughts on the appeal are this. The SG's chance of winning are higher than I initially thought, but I still remain hopeful. Legal communications are to remain confidential, this is a long establish principle dating back centuries and common law. However, FOISA enables publication of such communications, which goes against this principle of confidentiality. Given that the judges are of course legal figured themselves, they will very much appreicate this.
