A senior lawyer was arguing to save 46 convicts from the death penalty (hanging).

My biggest concern is the dictates of our Constitution and the court must uphold them

I just bumped into this very interesting story

In 1986, Hofmann and her then boyfriend Marco made a trip to Kenya. There, she met a Samburu warrior named Lketinga Leparmorijo and instantly found him irresistible.

She left Marco, went back to Switzerland, sold her possessions In 1987, she returned to Kenya, determined to find Lketinga, which she eventually did.

The couple moved in together, married, and had a daughter.

The Samburu are a pastoralist people related to the Maasai, and live in small villages in an arid area of central Kenya.

Most lawyers would ordinarily think the quoted rule is one but sadly it isnā€™t.

It 2 separate requirements and the court approaches it in three different stages.

Letā€™s look at how the rules is applied.

1. An application for Judicial Review must be brought promptly 1. Whatever happens, it must be brought within 3 months.

These are the two rules.

However the court adopts a very liberal approach by ensuring the application was brought promptly. If it was, the court goes on to consider the substantive claim.
