🧵I’ll keep my ting brief. Zondi JA rejects all of MK’s arguments and I mean *all*. But somehow towards the end reasons that s 47(1)(e) doesn’t apply to Zuma because the sentence could not be appealed. This means that only sentences imposed by the High Court or upheld/reinstated
or otherwise modified by the SCA or ConCourt fall within the provision but not sentences imposed by the ConCourt acting as court of first and last instance. But what is the constitutional basis for this? You won’t find it because it doesn’t exist.
