Biden is at 213 right now.
Can he break the record? Maybe, but it will be very close. He can realistically appoint a ceiling of 22 more judges in the lame duck, which puts him at 235. That assumes those 22 judges have 50 votes.
Complicating all of this is that multiple Senate Democrats are either retiring or lost their elections, so their attendance might be spotty. Vance's absence will help Democrats in this regard, but it might not be enough.
