Since I'm not involved with the trial or politically involved with any party, think it will be helpful to explain Syed Saddiq's case. I think a lot of people know about the charges against him but not necessarily the facts and the stance taken by the defence. There are actually two separate circumstances. The first involves Rafiq, Armada's assistant treasurer withdrawing 1 million from Armada's account in March 2020. According to Rafiq he was then asked to clear the funds by Saddiq to which he then gave 650k and 250k to 2 members

Fun fact: Malaysian prisoners under remand or detention without trial and some of those that are serving their sentence have the right to vote.

However, the right of nearly 76,000 inmates in 🇲🇾 is not actively facilitated by the prison authorities or the EC. In a 2016 suit filed by @anwaribrahim, the High Court decided that while prisoners have the right to vote, EC has no power to bring them to the polling station and it must be facilitated by the Prisons Department instead. Admittedly, this isn't quite practical for various reasons

Najib's case was heard in the HC. His right to appeal to the CoA and now subsequently to the FC is not barred.

Sam Ke Ting, on the other hand requires leave to appeal to the CoA and leave is restricted to questions of law.

This could be the distinguishing factor. Also in 🇲🇾, when defence is called it means that if you elect to remain silent you will be convicted. Sam Ke Ting opting to give unsworn statements from the dock as opposed to doing so under oath certainly did not help her. Not putting the defence during prima facie is 🤦‍♂️
