That phrase actually has a long-standing meaning in the telecom world and this ain't it. Furthermore, if we genuinely adopted a "sender pays" regime, ISPs would not like it much. /2

I know I'm late to the party, but a few observations about Netchoice v. Paxson (TX social media decision). It is a very frustrating opinion since it gets a bunch of stuff right (IMO), but goes way off the rails in other ways. /1 So what does the majority get right? At bottom, the principle that speech to enjoy First Amendment protection must be expressive. The rise of 1A as a general weapon against regulation has been facilitated by eliding this point. /2

Today, the @FCC Wireless Bureau and @JRosenworcelFCC reversed a serious injustice in the distribution of 2.5 GHz licenses to Native Americans.

@FCC @JRosenworcelFCC in 2019, the @AjitPai FCC created a window for Native Americans to apply for licenses in the 2.5 GHz band prior to the upcoming auction. These licenses would cover rural Tribal territory so that these tribes could build out much-needed broadband networks. /2

To summarize, Section 802 of the Communications Act requires "the Commission" to issue broadband maps pursuant to a particular methodology. Section 60103 of the IIJA says NTIA can't issue BEAD money until @FCC does new broadband map.

So I have now read the letter from DOT Sec. Buttigieg (and FAA Admin Dickson) to AT&T & VZ CEOs. It pretty much confirms the resolution I have been predicting is in the works: the FAA will let airlines self-certify that their altimeters won't be impacted.

As the letter explains: "the FAA will safely expedite the approvals of Alternate Means of Compliance (AMOCs) for operators with high-performing radio altimeters to operate at those airports." Let's unpack that sentence.

This week is a big one for the great @FAA v. @FCC 5G #Cband showdown. ICYMI Airlines 4 America (A4A), the trade association for airlines, filed an emergency pet with the FCC to delay activation of #5G in C-Band.

So Thanksgiving. A few things:
1. Modern Thanksgiving has absolutely zero to do with the "First Thanksgiving" of 1621. That Thanksgiving was a local one-off. Even the Thanksgiving of 1623 was about the end of a drought.

2. Nor would 1st Thanksgiving have been at the end of Nov. While there isn't consensus on the date, it is generally agreed that 1st Thanksgiving (1621) would have been when most folks had harvest festivals -- sometime in End of Sept to Early Nov. But definitely NOT the end of November.

A critical difference between New Deal Progressives (in which include myself) and LBJ Liberals. New Dealers sought a high standard of living for all Americans as a matter of right. this is why things like social security and unemployment insurance aren't means tested. /1 The heirs of LBJ, by contrast have no interest in maintaining a high standard of living for everyone as a matter of right. You're only entitled to a floor of survival.

Interestingly, the events of the last 24 hours highlight an issue I raised in Chapter 5 of “The Case For the Digital Platfirm Act.” Should laws or other legal obligations wrt content moderation apply only to dominant firms. /1 While we have much yet to investigate, it appears that most of the actual planning and organizing of the violence took place on smaller platforms such as Parler. Facebook and Twitter were used for organizing the general protests. /2
