Today the government announced an expanded right to review evidence before rape cases are discontinued. Viewed in isolation, this sounds sensible. But it’s part of a wider set of changes in sexual offence prosecutions. Taken together, those changes raise some serious questions.

The change highlighted here allows a second prosecutor to review the evidence before a rape case is discontinued. The intention is understandable — to avoid cases being closed prematurely. But it also risks increasing pressure on the Crown Prosecution Service (CPS) to proceed, pushing more cases into court even where the evidence is weak, and where outcomes may depend almost entirely on credibility.
