Back in court for day two. Q: Does Portland's near-daily use of force against protesters violate court order to use munitions only in life-threatening circumstances? We're focused on June 30th: when police used tear gas to protect their union building, which isn't public property For context, here's my thread from yesterday:

Good morning from Portland, where the city is arguing that its near-daily use of force against protesters doesn't violate a court order to use less-lethal munitions only in life threatening circumstances. Hearing runs today and tomorrow. Follow this thread for highlights. Wheeee! Portland police pepper-sprayed one protester just after ordering the dispersal of a protest outside the police union building. The court order bars police from pepper-spraying people for passive resistance.

City attorney to protester: "You could have just walked away."

The difference between police treatment of a Proud Boys rally yesterday vs their response to a protest last night against police brutality could not be more stark This picture, where police trumpet their seizure of a couple of worn out weapons from antifacist protesters, is pretty ridiculous considering the advanced weaponry they ignored at the Proud Boys rally

Good morning from Vancouver, Washington, where Proud Boys are already declaring victory ahead of today’s planned protests. The wins? @OregonGovBrown state of emergency and the decision to allow @ppb to use tear gas In the convoy, on the way to Delta Park. Happening now: Listen in as government attorneys argue that the Ninth Circuit should lift a restraining order banning federal agents from assaulting and arresting journalists
ca9.uscourts.gov/media/view_vid… Govt lawyer says journalists are not facing harm from federal agents, but that the order harms the feds: "every time a federal officer leaves a federal building and encounters someone on the streets of Portland, this injunction is currently hanging over their head."

New: Injunction now bars fed agents from assaulting journalists in Portland

Judge says journalists aren’t asking for “extra” rights to stick around &cover action after agents disperse crowds for one simple reason: feds don’t have authority to declare a riot and clear PDX streets Image Here's the full ruling. Story on the way

Portland, Day 74: maybe 150 people are gathered at Alberta Park for a march in support of black lives. Waning moon means it’s too dark for a photo, but as usual people are handing out free food and hand sanitizer. Overheard chatter about “wind swords” (leaf blowers) “Say her name! Breonna Taylor!” Image

“There has been a small army in Portland,” said one law enforcement official. “There’s expected to be a higher presence of federal officers. The question is how many for how long?” opb.org/article/2020/0… “According to documents reviewed by OPB, approximately 170 U.S. Customs and Border Protection personnel remained in Portland as of late last week...”

“Those documents don’t give totals for other agencies that have been part of the federal government’s response in Portland.”

.@ACLU_OR rejects judge's suggestion that it determine who is a legit journalist via distribution of its blue vests: "Nobody should have to obtain a license to speak."

Issue may be decided in a hearing on Thursday.

Background: courthousenews.com/whos-a-journal… This is all coming up because attorneys for the government claimed they couldn't tell who is a journalist, even with a court order requiring reporters to wear press badges. Govt said it couldn't see, in part bc the clouds of tear gas were so thick (yes, that's real life)

Caught the tail end of a Black Lives Matter car parade on my way to the courthouse to check out Portland’s 64th night of mass protests Victory flag on the steel fence where federal agents stood two nights ago, casually dousing protesters, journalists and legal observers with mace “like they were watering a row of plants,” in the words of one legal observer.

Headed into a hearing where attorneys will argue @DHSgov and @USMarshalsHQ should face sanctions for continuing to assault journalists after a judge ordered them not to.

Meanwhile, at the White House: Image Judge Simon says he's considering an order that would "redefine 'journalist' as someone who is authorized by the ACLU." Says @ACLU_OR could issue identification similar to the blue vests they now give their legal observers.

"This may or may not be a good idea," Simon says.

New: Federal police in Portland now under court order not to arrest or assault journalists and legal observers for doing their jobs. Government attorney says it plans to appeal.

Story on the way. “When wrongdoing is underway, officials have great incentive to blindfold the watchful eyes of the 4th estate,” Judge Simon wrote, citing Ninth Circuit precedent.

He added: “This lawsuit tests whether those principles are merely hollow words.”
