CITY OF HARARE TRAFFIC BY-LAWS ENFORCEMENT TAINTED WITH ILLEGALITY

1. Over the past few weeks there has been furore over traffic bylaws enforcement approach by Harare City Council (HCC) staff, which has seen vehicles being clamped and at times towed away. @TinofaMutevedzi 2. Matters came to a head when a vehicle owned by a high profile person was clamped. The individual complained on his Twitter handle leading to a hastily convened presser by the mayor whereat he announced that there will be changes to the traffic bylaws enforcement

1. So much has been said about Mafusire J judgment in the above case. I wish to exercise my freedom of expression on the case. @TinofaMutevedzi @kmugova @SANDEJAQ @thabanimnyama @counsel3000 @bmusonza 2. Essentially the judgment seeks to revive the Zhou J judgment that was torpedoed by the Supreme Court in 2021. I will not dwell on the legal intricacies around the judgment but zero on Economics missed by the learned judge resulting in a misdirection of tectonic proportions

@MelodyChakatsva @ZECzim 1. He fails to notice that with proper gerrymandering there is a real possibility that the opposition will lose Masvingo Urban seat.

2. In 2018 a total of 34, 947 votes were cast in Masvingo Urban, of which MDCA got 49.94% votes, with ZANU getting 36.16%.

Assuming the... @MelodyChakatsva @ZECzim ...the voting patterns stay the same, among those who voted in 2018, up to 13,000 voters could be moved from Masvingo Urban and distributed 5k and 8k to Masvingo West and Masvingo North respectively without affecting posing a risk of ZANU pf loss in those constituencies.

@matigary @JMafume 1. Following that court ruling, so much has been said but much much of what has been said doesn't tell the whole story. At the risk of insults, I have chosen to highlight some pertinent issues surrounding the judgment. @matigary @JMafume 2. It is common cause that on death of MT two factions emerged: Chamisa and Khupe factions all claiming legitimate leadership of the party. The dispute on which faction was in legitimate control of the party was never legally settled through known dispute resolution mechanisms.
