It was a mistake to not timely federally prosecute Trump & other ringleaders in '21 for, you know, trying to overthrow our democracy. Unlike so many big accts fearful of criticism from a select, loud few, I will say the name of the 1 person who is responsible:
Merrick Garland If you defend this rank incompetent I will block you. If you continue to bemoan our current state of affairs w/out casting blame where it belongs & saying his name, shame on you. Garland is responsible for Trump not being currently incarcerated in a fed prison. D-O-G help us all

Standing alone, it's disqualifying for a POTUS candidate to be a convicted felon. 1/ Standing alone, it's disqualifying for a POTUS candidate to be a criminally indicted defendant in 1 case, much less several cases. 2/

Yesterday, I got a glimpse into the deranged MAGA cult w/ a tweet that blew up. What struck me about the posts from these fools is how their reality is based on lies/disinformation from RWM, even repeating discredited Putin talking points about 🇺🇦. We are in real trouble. 1/3 Not TIMELY holding Trump et al accountable for serious alleged criminality has resulted in anti-democratic forces metastasizing. The core MAGA crowd represents about 25% of the country. They are armed, violent, insane, & will do whatever their cult leader says they should do. 2/3

Regardless of what Smith does, Garland gave up a lifetime judicial appointment to become the worst AG in history bc he has done almost 0 to protect our democracy from the gravest threat it has ever faced as well as walking away from many other alleged crimes of Trump et al. 1 Yes, worse than Mitchell, Meese etc bc he's utterly failed to rise to the challenge of timely/aggressively protecting our Republic. He's been enabled by an equally inept/cowardly DAG @LisaMonaco, Crim Div Chief Ken Polite @DOJCrimDiv & his former clerk Damian Williams @SDNYnews 2

As noted, I'm on mastodon. When u switch over, try to keep your same pic and name initially so we can find each other. Also, post a link in your Twitter profile like I did. We stay on twitter too but we need alternatives to Elon Maga.

For 18 months, I have been pressing Garland/@LisaMonaco to take timely action to protect our democracy including charging Trump/others for alleged crimes that have occurred in plain view including Mueller obstruction, 1/6, stolen docs, fraud, tax evasion, etc. So far nothing. 1/ Though most agree w/ me, some have not which is their right. What boggles my mind however are those on here, some w/ zero legal experience, who have viciously attacked or blocked me just for advocating for timely prosecutorial action which we all want and desperately need. 2/

Today, Navarro was awakened early by arresting agents. In their presence, he was probably allowed to dress. He was then cuffed, transported to FBI/Marshals' office to be processed (mug shot/fingerprinted), & is now in lockup w/ other alleged criminals awaiting his ct appearance. He will need to either retain an attorney or have one appointed for him if he is financially eligible. This is meant to be a wakeup call to this lunatic to realize what he has done to himself & our country. Agents may also be executing search warrants.

If this is upheld, she will be destitute. This judgment is not dischargeable in a personal bankruptcy filing (since it is an intentional tort). Depp will be able to enforce this judgment against her property (she just purchased a home), investment accts, & present/future income. She probably does not have a protected pension like OJ has from the NFL. Given the bad blood between these former spouses, I expect Depp to be aggressive. If @elonmusk comes to her rescue as he did w/ her promised charitable contributions, such help would be taxable to her.

"First of all, continuing to do business in Russia after this invasion is the equivalent of continuing to do business in Nazi Germany when Hitler started persecuting the Jews. It’s the same thing.
nytimes.com/2022/04/09/bus… Every business has a moral obligation to get out of Russia, no matter what the cost is. I don’t think anyone should even be concerned about returning bc everyone will be welcomed back in a post-Putin regime. In a Putin regime, I don’t think anyone should even want to go back."

Over and over I see the same inaccurate/inapposite talking points defending Garland/Monaco's abysmal record of accountability:
"Airtight" assumes that there is an actual & specific investigation all along which may not be case or it belatedly started in '22. 1/ "Brady rule" is a defense of inaction made popular by non-attorney, Garland true believer MuellerSheWrote. All Brady requires is disclosure of potentially exculpatory info to defense AFTER a case is filed. It is NEVER a reason to delay the bringing of a meritorious case.2/

So let's get down to brass tacks as to how @ManhattanDA @AlvinBraggNYC can save the Trump prosecution. As I have told him privately & also on this platform, this is what I think he should do to hold Trump accountable for his crimes. 1/ Charge Weisselberg w/ Enterprise Corruption bc it fits the alleged criminality, carries w/ it a 25yr max prison penalty, & would give him a real incentive to cooperate or spend the rest of his life in prison if convicted. He is presumed innocent.

That Russian convoy heading to Kyiv needs to be taken out. Period. Taking it out will save hundreds of thousands of lives, including many civilians, women and children.

Basic principles as to the federal prosecution of Trump:
1 There are multiple fed cases in multiple districts for multiple crimes, some fully investigated
2 Targets like Trump who constitutes an ongoing danger to public safety/our democracy must be charged STAT 1/ 3 No case is airtight!
4 State prosecutors don't have the resources to adequately hold a dangerous career criminal like Trump accountable & they have no jurisdiction to prosecute him for his multiple fed offenses
5 Investigations can continue after filing of initial charges 2/

If I was AG, this is what I would have done w/ Trump: I would authorized his arrest on the Mueller obstruction charges w/in my 1st month in office. During the 2nd month, I would have repaired DOJ's relationship w/ @MichaelCohen212 so as to indict "Individual 1" in the SDNY. 1/ During the 3rd month, I would have authorized Trump's prosecution for the '17 Inauguration Fraud case on the strength of doc evidence & the credibility/resolve of @SWinstonWolkoff. While these 3 cases were being adjudicated, a lightning fast investigation would be taking 2/

Trump can be federally arrested this week pursuant to a sworn criminal complaint from a case agent for 1/6 & election fraud crimes. Grand jury can return an indictment at a later time, 30 days after Trump's initial appearance in court assuming he is released on bail. Investigation can continue apace after Trump's arrest. He will try every trick in the book to delay his adjudication including possibly even falsely claiming he gave a pardon to himself. Arrest his alleged accomplices too. Give them an incentive to cooperate. Stop wasting time.

Now that the review of Rudy's electronic data has been reviewed, we can expect the filing of charges by @SDNYnews barring anything unforeseen. It wouldn't have gone this far if it was not going to conclude w/ charges. However, I don't consider Rudy to be a potential cooperator.1/ He is barely competent as it is, a known prevaricator, probably a chronic alcoholic, & just would be incapable of cooperating fully, truthfully, & credibly. Trump, for all his idiocy, knows this which explains why he's not interested in funding Rudy's defense to buy him off. 2/

Relevant to Trump/accomplices claiming that they honestly thought the election was stolen. A reasonable/common sense test applies.
From justia.com/criminal/defen…
Mistakes of fact arise when a criminal defendant misunderstood some fact that negates an element of the crime. 1/ For instance, if an individual is charged with larceny but believed that the property he took was rightfully his, this misunderstanding negates any intent to deprive another of the property. 2/

Garland defenders make an assumption that isn't fact-based: that he has been all along secretly targeting Trump/accomplices. At least through 2021, he clearly has not been. Not a single grand jury subpoena, search warrant, or an arrest of a potential cooperator. Inexcusable. I am hoping he has now heard our collective voices & is now motivated to act aggressively & timely as he must.

We Shot a Moose, Class. There Will Be a Quiz. nytimes.com/2022/01/10/din… When his middle school students gave him the OK, Mr. Bjorkman set up his rifle and fired one shot. It was a lethal blow to the roughly 950-pound cow moose. The students gasped at the sound of the gunshot, then giggled with excitement.

Process of federal cooperation as a target/defendant, before or after initial charges are filed:

1 Confidential proffering w/ AUSAs/Agents, w/ defense counsel, revealing all criminality w/out exception pursuant to "Queen for a Day" agreement providing for limited use immunity 1/ 2 After several proffers, DOJ evaluates credibility and information value
3 If DOJ wants to work w/ the cooperator, a cooperation agreement is prepared often w/ a proposed Information (substitute for indictment, requiring no grand jury), along w/ grand jury waiver. 2/
