Farstein's lawsuit is a baseless SLAPP, gonna end up getting dismissed on both First Amendment and "substantial truth" grounds

She's hoping the expense to @netflix + @ava of litigating will be high enough that they'll apologize and move on instead of getting the case thrown out
First, remember the baseline rule that courts review allegedly defamatory comments in the context in which they were made

That alone makes it hard for Farstein to win, b/c ppl don't watch *any* Netflix show for its 100% factual accuracy

Basically, ppl expect when they're watching a movie or a mini-series that there's going to be some "artistic license" to make the story more compelling than reality

National origin is one of the protected categories under Title II of the Civil Rights Act of 1964. This seems pretty standard as far as legal guidance goes, addressing inventive ways of trying to skirt civil rights protections
"I'm gonna have your illegal Spanish-speaking @$$ shipped back to Mexico!" is already prohibited conduct in public accommodations. "I'm gonna call ICE on you!" is functionally the same thing.

If that law seems too restrictive, the easy solution is to just not run "any inn, hotel, motel, or ... any restaurant, cafeteria, lunchroom, lunch counter, soda fountain, or ... any motion picture house, theater, concert hall, sports arena, stadium or other place of exhibition"

The motion is weak and the basis is LOLable, but my suspicion is that the judge will grant it (though likely for less than 3 weeks)

Defendants will argue the burden is on Plaintiff to show good cause (the motion doesn't do that), plus ongoing harassment
