Breaking: Judge Chesney (N.D. CA) issued a preliminary injunction blocking DHS effort to make fee waivers harder for #immigrants seeking #citizenship.

USCIS tried to make it harder for low-income #immigrants to qualify for a zero-fee #naturalization application, just by changing the required form. Instead of proving either low income or eligibility for means-tested benefits, only low income would be allowed.

Today, a federal judge said that changing a form this way could be an end-run around the proper regulatory process.

And this doesn't bode well for the #immigration fee hike recently proposed by DHS, which would eliminate fee waivers entirely.

Judges don't like rulemaking mischief.
