Yo @Newsweek: burn this trash in its entirety.
Not just because it is bad & I disagree with it (it is, I do) but bc it is legally incoherent, partially justified by past unlawful mass deportation of US citizens (all apparently fine now!), and just dripping w/bad faith generally
Among many other stupid points, Eastman says it's fine not to recognize Harris (born in Oakland, CA in 1964) as a citizen bc the U.S. government has declined to recognize natural-born citizens before.
WHEN IT ILLEGALLY DEPORTED 600,000 OF THEM

The legal basis of Eastman's "argument" (such as it is) that Harris may not be a citizen comes from the worst strains of #MAGA groupthink & has been roundly debunked. If the Supreme Ct were ever to adopt it, tens of millions of U.S. citizens would be disenfrancished & stateless
Short answer: it does not depend.
For as much as I do appreciate the scholars doing deep dives on Wong Kim Ark in response to this frozen dumpster dogshit, can we maybe just agree to stop giving these fringe arguments the dignity of analysis and stand on the 14th Amendment and 120+ years of settled law?
UPDATE: @Newsweek has now rushed to clarify that this is not intended to spark off another round of anti-Black #birtherism! Cool. So why did Eastman previously argue that Ted Cruz was a natural-born citizen despite birth in Canada?
CANADA.
