The Federal Intelligence Service (BND) is to be supervised by a new authority - the "Independent Control Council" - in its electronic surveillance actions.
This supervisory authority should be allowed to see everything that the German foreign secret service is doing worldwide in its strategic investigation, including search terms such as e-mail addresses or telephone numbers with which data streams are scoured.
The paper is the reaction of the federal government to a judgment of the Federal Constitutional Court from May of this year on the surveillance practices of the BND.
The Karlsruhe judges had ruled that the current practice of the BND of being allowed to eavesdrop on foreigners abroad without restriction was not compatible with the German Basic Law. They also criticized the constitutional control of the secret service.
The BND often wrongly refers to the fact that the agreements with other services are too secret to be presented to judges or other supervisory bodies.
In its judgment, the court therefore demanded comprehensible justifications for secrecy and wiretapping. The rule of law of espionage activities must also be monitored by an independent body.
