Received a STAYED sentence.

Davion Lazarick Gaines was charged with shooting up the Minneapolis 4th Precinct with a machine gun in July 2022. Here's the gunshot audio and our thread at the time:
At the time he was charged, HCA Mike Freeman faux huffed and puffed and said, "Reckless gun use will not be tolerated."
[Narrator voice] Pssst, it will be tolerated.
Under a plea deal, two felony charges of possessing a machine gun and reckless discharge of a weapon were dismissed.
He pled guilty in October to one felony count of riot. His 12-month sentence was stayed by Judge Kerry Meyer EVEN THOUGH he had another open case on a felony charge of drive-by shooting. That case is still pending.
LESS THAN 90 DAYS LATER, in December he was charged in a new case with felon in possession of a firearm. That case is still pending, and Gaines remains in custody on $200,000 bail.

Daniel William Scharffbillig, 07/30/1989, of St. Paul was convicted in December 2022 on GM carrying a firearm without a permit to carry. Under the terms of a plea deal, two other counts of driving after revocation and drug paraphernalia were dismissed, and the Rosemount city prosecutor agreed to a stay-of-imposition and probation to the court - no prison or jail time.
NEW: Scharffbillig was charged on Friday with fleeing Inver Grove Heights police in a Kia stolen out of St. Paul which he subsequently crashed into a median. Upon arrest, Scharffbillig was found in possession of several bump keys, which can be forced into a vehicle’s ignition during vehicle thefts.

Bobby Neal Cole, Jr., 27, was convicted in Nov. 2019 on 1st degree aggravated robbery with a gun aboard the Metro Transit Green Line LRT in which the victim told the court she was "terrorized with fear."
The prosecutor tossed Cole a plea deal agreeing to dismiss two counts of felon in possession of a firearm/ammo in exchange for a guilty plea.
Ramsey County Judge George T. Stephenson approved the deal, then granted Cole a stay on the 81-month prison sentence in a downward departure from sentencing guidelines.

NEW: Cole was taken into custody by Ramsey County this week after being charged in the Feb. 2021 murder of Raymond Renteria Hobbs, 20, in a St. Paul drive-by shooting (which occurred while Cole SHOULD HAVE BEEN IN PRISON). The public indictment was posted in court records yesterday charging Cole with five felonies.
Cole was arrested in Illinois.

Christopher Reauld James, 11/25/1996, of Mpls was convicted in November on felon in possession of a firearm. Charges say he threatened a Metro Transit bus driver and a female passenger while throwing objects at the passenger in Brooklyn Center and said he had a gun.
Surveillance video showed James hide an object while he was fleeing police. A loaded .22 handgun was found at the location.
James is prohibited from possessing guns due to a prior robbery conviction (stayed by Judge Regina Chu).
James' 60-month prison sentence on the new conviction was stayed by Judge Julie Allyn in a downward departure from guidelines.
Last week, he was arrested on a warrant related to a probation violation in the case. Judge Regina Chu dismissed the violation and continued the stay and his probation this week. He's out. Free.

Violent offender Immir Fyontane Rice, 24, was convicted in Jan. 2022 on felon in possession of a firearm. He was tossed a plea deal by Hennepin County for a stay-of-execution on the 60-month sentence which was agreed to in a downward departure by judges Paul Scoggin and Rachel Hughey.
NOW: Charged with double murder in the Feb. 2023 shooting deaths of two people at 28th and Bryant/Colfax Ave S.
He should have been in prison at the time of the murders.

The government failures in regard to this offender cannot be overstated.
Manamany Omot Abella was convicted in 2020 in two cases with being a felon in possession of a firearm. Plea deals in the cases dismissed charges of drive by shooting and 2nd degree assault with a gun (because MN is totes serious about gun crimes), and he was allowed to serve the two 5-year sentences concurrently (along with sentences in two other felony cases), despite his history of violent crimes including violent crimes as a juvenile.
Instead of the 13.5 years he was sentenced to, he spent less than 20 months in prison due to @MNCourts weak concurrent and two-thirds sentencing rules, AND @MinnCorrections additional decision to let him out even earlier after serving just half of the lame 40-month concurrent and two-thirds sentencing calculation.
Abella is now charged with murder in a new drive-by shooting last week - WHEN HE SHOULD HAVE BEEN IN PRISON.

Joshua Matthew Goldman of St. Louis Park was tossed a plea deal on a gun pointing charge (threats of violence). Under the deal, the felony charge was downgraded to a gross misdemeanor. ZERO time to serve in a downward departure. @MNCourts is totes serious about gun crime.

Kahn Z. Gbor is a chronic offender with at least 30 convictions, including multiple felonies, as well as multiple active cases.
Gbor was convicted in April 2023 on a felony count of felon in possession of a firearm.
DESPITE Gbor's lengthy and active criminal history and pending cases, the 5-year prison sentence was STAYED by Judge Lisa K. Janzen in a downward departure from sentencing guidelines.

Angelique Kay Franson, 08/21/1992, was convicted in August on a charge of felon in possession of a firearm. Her 60-month sentence was stayed by Judge Carolina Lamas in a downward departure from guidelines. She was credited with time served in jail and was placed on probation. (Originally stopped by UMPD in a stolen vehicle, she was found with a loaded gun). She is prohibited from possessing firearms due to prior felony assault and drug convictions.
Another case on 2nd degree riot was dismissed (In that case, Franson was part of a group that attacked and assaulted a man in downtown Minneapolis).
Another conviction on possession of metal knuckles was also stayed. (Park police/The Commons Park).

Sex offender Kevin Jay Bruce, 01/03/1990, was just convicted in June 2023 on felon in possession of a firearm but his 5-year prison sentence was stayed by Judge Lisa K Janzen in a downward departure from guidelines.

Of 773 felony cases in Hennepin County that involved firearms, only 28.7% saw a mandatory minimum sentence imposed and carried out. Of those who were convicted, about 48% did not get a mandatory minimum sentence.

Minnesota is totes serious about gun crimes. New #MNLEG legislation proposes to eliminate mandatory minimum sentences for gun crimes, and also creates more bureaucracy and administration - and of course, throws more taxpayer money at the bureaucracy while prosecuting less.

North Minneapolis 'Lows' gang member Marquez Demar Hill-Turnipseed was convicted in Sept. 2022 for being in possession of a machine gun (Glock with a switch).
He was sentenced to ONE DAY of time served by @MNCourts.
Nine months later, Hill-Turnipseed was scooped up by the feds in possession of another machine gun (Glock with a switch).
The feds have to repeatedly clean up the mess made by Minnesota prosecutors and courts.

Dexter Armond Jackson was convicted in March 2023 for being a felon in possession of a firearm (prohibited due to a prior conviction for armed robbery).
His 5-year prison sentence was stayed in a downward departure by Judge Lisa K. Janzen, and he was placed on probation. Two warrants, new crimes, and 1 year later, he's charged with randomly attacking a college student in #Dinkytown with a gun.

Trevion Armond Figgs was just convicted in Ramsey County in January on a charge of being in possession of a firearm without a serial number. Figgs had been arrested last June following a shooting in St. Paul where 40 shots were reported and 27 shell casing had been recovered. He was found with a gun in his possession without a serial number that was a forensic match to the casings recovered.
You know the rest... the felony was downgraded to a gross misdemeanor and his sentence was stayed by Judge Andrew Gordon in January 2024, because Minnesota is totally serious about gun crimes.
TWO MONTHS LATER in March of this year, (when Figgs should have been in prison but wasn't because MN is weak), Figgs was charged with attempted murder of Ramsey County Deputy Joe Kill after firing shots with a rifle from a moving vehicle during a pursuit.
Also, Ramsey County has finally decided to charge Figgs with attempted murder in last June's shooting in St. Paul, which they should have done in the first place.

Multi-time violent felon Devonte Deshawn Dickerson, 11/26/1997, was convicted in 2021 for being a felon in possession of a firearm.
In addition to being bailed out by MN Freedom Fund after being charged, former Judge Martha Holton Dimick granted Dickerson a downward departure on his felony sentence upon conviction, despite his criminal history.
Two months after being released on parole (after serving only 2/3s of his downward sentence), he was charged with felony auto theft. He was convicted in Feb. 2024, and Judge Marta Chou stayed his 30-month prison sentence, despite still being on parole from the gun conviction (he should have been sent back to prison to finish the gun crime sentence, in addition to the auto theft conviction).
Now, he's back in custody on probable cause narcotics.
Minnesota loves creating crime victims and is not a serious state.

Larry Bernard Clark, Jr, 05/30/2003, of north Minneapolis was convicted last year for being in possession of a machine gun (Glock with an auto sear).
He was tossed a plea deal by Joseph Paquette from @HennepinAtty @MaryMoriarty's office offering a stay of imposition (no prison), probation, and 20 days of picking up trash in the park on STS.
Judge Kerry Meyer thought that sentence was way too harsh and reduced his STS to 11 days of picking up trash and spun him out the door.
Clark has violated probation at least twice since his fake sentencing.
Judges Julie Allyn and Hilary Caligiuri separately continued Clark's stay of imposition and probation after each violation and spun him back out the door.
NOW: Clark was picked up on another felony probation violation warrant in the case this morning.
How many spins?? Pathetic.
BTW, @DMNnews didn't charge him federally after all the tough talk of cracking down on machine gun possession.
