I guess my thinking is the TCPA-related damages wouldn't be actionable b/c Vic's prior conduct – consulting multiple attorneys who told him he didn't have a case, telling Rekieta he was on board with the GFM, etc – made it clear he was going to proceed regardless of the risks

I think the theoretical answer would be yes it could be tortious, but on a practical level I don't see how you'd prove by a preponderance that the prior attorney's misconduct was the but for cause
