We have the transcript from today's Flynn hearing

From @SidneyPowell1 - "There have been stunning failures to produce Brady in this case"

The DOJ sat on Page/Strzok texts for months in violation of the Court's discovery order.

cc @KerriKupecDOJ Image
@SidneyPowell1 @KerriKupecDOJ More documents the DOJ (NSD/Liu - of course) refuses to produce:

1) "Russian agent" exoneration memo dated 1/30/17

2) Memo clearing Flynn of Logan Act on 2/8/17. (This was said to be part of the reason for the FBI interview.)

*Go ahead, see if those are in the Mueller report.. Image
@SidneyPowell1 @KerriKupecDOJ Potential signs for where this is headed:

"Egregious gov't misconduct and long-time suppression of crucial Brady material that should have been provided to the defense before there ever was a plea." Image
@SidneyPowell1 @KerriKupecDOJ This is big.

They've "identified material differences between the agents' notes from their interviews of Mr. Flynn on the 24th and the 302 they produced." Image
@SidneyPowell1 @KerriKupecDOJ Another revelation: the original 302 is missing.

The DOJ says "they don't have it." Image
@SidneyPowell1 @KerriKupecDOJ At the 12/2018 sentencing hearing, Brandon Van Grack (Special Counsel/NSD) basically accused Flynn of being a foreign agent (section 951 violation).

Turns out Flynn briefed DIA on his meeting with Turkish officials - also kept from the defense (and the judge). Image
@SidneyPowell1 @KerriKupecDOJ Judge Sullivan takes notice:

If "there was no factual predicate for that FARA violation, then it should not have been mentioned at all as a potential 'benefit'" Image
@SidneyPowell1 @KerriKupecDOJ Van Grack admits to withholding non-public Page/Strzok text messages. Image
@SidneyPowell1 @KerriKupecDOJ DOJ says it has "provided all drafts of that interview report [302s] of which it is in possession."

The powerful DOJ/FBI can't find a document its agent created?

Makes you question the thoroughness of their search... Image
@SidneyPowell1 @KerriKupecDOJ Finally, the US references a motion filed under seal by @SidneyPowell1 (filed in support of their motion to compel)

Redactions will be limited; expect it to be unsealed in the coming days. Image
@willchamberlain was there and has a really good thread putting these excerpts into context.

Edward Snowden exposed the worst 4th Amendment violations in US history: the unlawful collection of data on millions of Americans.

His fight was on behalf of the American people.

For that @Snowden deserves a pardon from @realDonaldTrump Image
Recall what Snowden helped expose:

1) The illegal collection of metadata of millions of Americans

2) NSA plans to "Collect it All" and "Exploit it All"

3) Economic espionage and the abuse of private data ImageImageImage
Forget the clichés and talking points of pundits and gov't officials.

Instead, read the source documents hosted by @ggreenwald

They show the scope of domestic surveillance abuses and global US operations.

The DOJ has filed its Kevin Clinesmith sentencing memo

They want incarceration.

DOJ: Clinesmith wasn't just altering e-mails - he was lying about Carter Page in DMs to the FBI agent.

Thread. ImageImageImage
Why the Clinesmith lie was material:

"It would raise the issue of whether [Carter Page] had those interactions with the intent to assist the US gov't."

It would go to the "loyalties" of Carter Page.

Clinesmith knew FISC needed to be informed.

@AWeissmann_ disagrees 🤦‍♂️ ImageImageImage
Clinesmith's lies "allowed the FBI to conduct surveillance" on @carterwpage thru a FISA application that "lacked probable cause"

He violated the duty of candor to the FISA court. ImageImage

We have Ghislaine Maxwell's unsealed deposition.

Question: Did you invite minor Virginia Giuffre to Epstein's home?

Maxwell: "She came as a masseuse."

Thread. Image
Ghislaine Maxwell admits that Epstein's masseuse was a minor.

Maxwell: "Virginia Roberts (Giuffre) who you are referring to was a masseuse aged 17."

Was [redacted girl] 13 years old when you met her?

Maxwell: "I have no idea." ImageImage
Maxwell evades the questions -

Question: Did the massage therapists "perform sexual acts for Jeffrey Epstein?"

Maxwell: "I don't know what you mean by sexual acts." Image

DOJ produces new Flynn evidence - 1/25/17 Notes FBI OGC lawyer notes.

Logan Act: "no reasonable prosecutor" would proceed.

Flynn call w/ Kislyak similar to "other transition teams"

"First time to use [Logan Act]"

Thread. Image
TOP FBI lawyer James Baker:

"How do you assess § 1001 (false statements) when you wouldn't prosecute the underlying crime?"

Big concession that this wasn't about the broader Crossfile Hurricane investigation. Image
Assessment of whether Flynn is in a "covert relationship w/ Russia":

"No, probably not based on facts to date and interview."

Will be necessary to compare this to the Flynn NSLs handled by Clinesmith. Possible predication issues. (See pic) ImageImage

🚨Flynn update - Interview 302 from FBI Agent William Barnett

"BARNETT believed the prosecution of FLYNN by SCO (Team Mueller) was used as a means to 'get Trump'"

Thread. Image
Agent Barnett was assigned to Crossfire Razor (the Flynn counter-intel investigation).

Barnett was later assigned to the Special Counsel team.

Barnett: the predication for the Flynn investigation was "not great" Image
Crossfire Hurricane source (likely Halper) accused Flynn of leaving a 2014 event with an undisclosed person.

Perhaps @RealSLokhova

FBI assessed this information to be not accurate Image
