Agree: Whether insider trading would be indictable depends on facts such as patterns of purchases and the content of the briefing.
I also agree about the larger issue: Things can be immoral and wrong even if they can't be charged as a crime.

More specifically, I'd say that they don't think such laws should exist. They think federal agencies and the laws promulgated by the agencies constitute un-American infringement on personal liberty. For them, it's like a form of civil disobedience.
