We talked with our friends at @OpenJusticeBalt today about Marilyn Mosby's performance of demanding Hogan release prisoners. Here's what we learned.
@OpenJusticeBalt We asked for data on people charged in the last three weeks, a time period we chose because it's about a week after residents and officials started panicking in earnest about COVID-19.
OJB queried the available databases and found 205 cases of newly-charged people and 68 cases involving warrants going before commissioners between 3/23 and 4/10.
Of those cases, 71 were released on recognizance, 42 were held on bail, and 160 were held without bail. There are no bail reviews in this count, and SAO can claim that they don't dictate what the commissioners do. So what about bail reviews?
Note: bail reviews are public proceedings. With the closing of the courthouses, these are now being done in secret and can't be observed by us or by anyone. Nonetheless, OJB is still able to look at the data available. There have been 179 bail reviews in that timeframe.
Of the 179 bail reviews, 37 ended in release. 107 ended in no bail. That's at least 107 cases - that we know of - where @BaltimoreSAO, which is run by Marilyn Mosby, argued to hold someone without bail. Beginning well into the pandemic.
The local and national media, meanwhile, have been regurgitating Marilyn Mosby's press releases where she pretends to be advocating for the release of prisoners to slow the spread of a deadly respiratory virus.
There are now confirmed cases of COVID-19 inside the facilities where Marilyn Mosby has placed people DURING the time she has been pretending to advocate for decarceration. Including facilities housing children.
In the case of #KeithDavisJr, who has asthma that is already complicated by the injuries he sustained when he was shot in the neck by the police, @BaltimoreSAO argued last week - in arguments based on outright lies - that he should not be released to home confinement.
Like all prisoners, Keith is at extremely high risk of contracting this virus inside the jail, and extremely high risk of dying from it due to the health problems inflicted upon him by the Baltimore police.
Marilyn Mosby is creating a scene and attempting to focus our attention solely on Larry Hogan (who is also complicit) to keep us from looking into what SHE is doing in the now-secret hearings the court is conducting shielded from the public.
@BaltimoreSAO, under the direction of Marilyn Mosby, is disappearing citizens of Baltimore into jails where she knows some of them will die, while she conducts a PR blitz blaming the governor for not letting them out.
Larry Hogan has an absolute moral duty to release people NOW. But Larry Hogan is not participating in secret hearings, and he is not asking judges to put MORE people in jail at the height of this crisis. Marilyn Mosby is doing that.
We are calling on @GovLarryHogan to exercise his power to mitigate the damage @marilynmosbyesq is causing by releasing people from jails and prisons immediately. We are calling on @BaltimoreSAO to stop seeking to have people placed and held in jails.
We are further calling on @BaltimoreSAO to publicly share info on all cases where they have sought to have defendants detained or argued against release since March 23.
And we are calling on the @BaltimoreSun, as the last remaining mainstream newspaper in the city, to exercise its journalistic responsibility to the public by investigating and reporting on the massive discrepancy between Marilyn Mosby's vanity campaign and her actions.
