This morning a firearms examiner from BPD testified for the state. She purports to have independently repeated a test done by another examiner before signing off on his conclusion. His test took 2.5 hours, hers took 16 minutes.
She also testified that she doesn’t recall ever being proficiency tested on the type of gun at issue in this case; her proficiency tests have been on many types of guns all of which function quite differently from this one.
Defense mentioned that test fires were lost (this has been discussed in motions outside the jury’s presence as well), but the judge sustained an objection from the state.
She also testified that on a proficiency test, “inconclusive” is never considered a wrong answer. An examiner can fail to identify or exclude a match by answering “inconclusive” and still pass the proficiency exam.
A dr from OCME testified as well. She conducted the autopsy of Kevin Jones. Her testimony was an upsetting reminder of what was done to Mr. Jones. We won’t repeat those details here. The defense just noted that OCME’s records are very detailed unlike the other involved agencies.
Another medical examiner could for instance use the photos and notes to see exactly what was done and how conclusions were reached. Not the case for the BPD crime lab’s reports.
