This is from the governor’s spokesman, @FordPorter1:
The magistrate’s order does indeed reference the governor’s executive order 121 and its forbidding of mass gatherings. Arrest was made by capital police, not RPD.
The issue remains that RPD seems to be saying they can arrest people for protesting even if they are social distancing or not. I spoke with Wake DA Lorrin Freeman and she said that may be technically correct. However, in this case ...
.. protesters were not distancing despite warnings. One woman was arrested after declining to leave. Freeman was consulted before the arrest. The DA said “we have a strong history here of being respectful of civil disobedience ... we see charging and arrest as a last resort.”
Co-chairs of the #ncga senate’s judiciary committee, both Republicans and attorneys, have now written the governor about this.
