Here's how it starts. 
The case is called "Tesla, Inc. v. Tripp" because Musk initiated the case. It was not "brought by" a counterparty (Tripp). It was "brought by" himself. He can stop at any time.
Elon is on the record saying he took a whistleblower to court merely on a hunch.

Previously, he equated a PhD student to an attempted murderer for leaving a parking lot slowly, and then relied on false information from an actual murderer.
A few initial thoughts on all of this: these communications make clear that the real $TSLA Board of Directors is two people: Elon Musk and Claire Boucher a/k/a Grimes a/k/a Deth stayerr. Elon needs permission from no one else to criminally prosecute a whistleblower.
Also, as before, Elon appears to be mentally ill. Martin Tripp posed a threat to no one, let alone all of Nevada, as the Storey County Sheriff's Department quickly ascertained. Yet former $TSLA VP Dave Arnold decided not to retract any press statements.
And finally for tonight: $TSLA could lose this case. Elon's lawyers have triumphed in the face of opposing-party-attorney incompetence in the past, but there's no guarantee that will happen a second time around. Tripp's lawyer handled the deposition very well.
