After Bridgegate and McDonnell, it's very clear that Congress needs to amend the federal public fraud laws to cover more categories of corruption in careful detail. Federal prosecutors keep asking SCOTUS to expand the current laws, and SCOTUS keeps saying no.
To oversimplify the matter, prosecutors keep trying to apply federal criminal laws to sleazy, tawdry conduct by public officials that DOES constitute an abuse of office—and behavior we could theoretically criminalize—but does NOT clearly fit Congress' current definition of fraud.
The injustice of these cases lies partly in the fact that public officials accused of fraud can obtain expensive lawyers who appeal their cases all the way to SCOTUS. Prosecutors stretch the law to charge questionably criminal conduct all the time, but most defendants plead out.
It seems unfair that corrupt public officials—who commit egregious fraud that undermines faith in government—get fancy lawyers who reverse their convictions at SCOTUS, while thousands of indigent defendants lack resources to push back against overzealous prosecutors.
