That's legally fine (it's in CETA, so, yeah), but it's a really poor optic for the politics (as seen by the response to my OP)

Of course, you might argue that's exactly why it's kept in: so UK can wave it around and claim a win

but...

'take account' means, well, not very much at all

it's not an obligation to make adjustments, and doesn't result in anything more than a letter from the EU saying they've taking UK concerns into account (somehow)
