This👇🏻is why defense lawyers must demand the underlying evidence & identification of the specific allegedly “false” info BEFORE the client pleads guilty. You have to decide -for yourself- whether the statement was: (1) made, (2) is in fact false, & (3) is material.
Defense 101.
The only reason prosecutors won’t give this basic information to defense counsel to let them do their duty is that there’s a problem w/the govt’s case. Which tells you that you should NOT be pleading.
A good, ethical prosecutor will tell you: this is what we have, see for yourself, help your client understand it’s in their best interest to plead. And then if you have questions about their proof on an element, you go back & forth on the proof he has & maybe that you have.
And you keep doing that until: (1) you’re convinced (client pleads guilty) or he is convinced (prosecutor drops the charge) or you decide you don’t agree with one another’s analysis (case goes to trial). This is how it actually works.
