Today on behalf of my group of distinguished amici, we filed a 2nd brief in Flynn’s case.This time in the Court of Appeals. Although the Court did not invite amici, it has been accepting them in this case of public importance. You can read the brief here: drive.google.com/file/d/1irwKgE…
We tailored the brief to deal precisely w/ the 2 most important issues before the Court of Appeals. Our brief is the only amici brief to argue - as does DOJ’s brief - the relevant law on separation of powers & on contempt, both of which dictate favorable results for Gen. Flynn.
You can also find the brief on pacer.gov. Case number 20-5143 in the Court of Appeals for the DC Circuit. There are briefs supporting Gen. Flynn there too from members of the House of Representatives & the Senate.

This👇🏻is why defense lawyers must demand the underlying evidence & identification of the specific allegedly “false” info BEFORE the client pleads guilty. You have to decide -for yourself- whether the statement was: (1) made, (2) is in fact false, & (3) is material.
Defense 101.
The only reason prosecutors won’t give this basic information to defense counsel to let them do their duty is that there’s a problem w/the govt’s case. Which tells you that you should NOT be pleading.
A good, ethical prosecutor will tell you: this is what we have, see for yourself, help your client understand it’s in their best interest to plead. And then if you have questions about their proof on an element, you go back & forth on the proof he has & maybe that you have.

Although the POTUS uses the word “designation” that is not what the AG either said or did. We have a designation process but it is only for foreign groups. It means the group itself is deemed the problem. /1

Barr is saying Antifa’s *activities* are domestic terrorism, which is defined in the PATRIOT ACT, but isn’t a separate crime or “designation.” That means govt resources & focus can be used to investigate activities for violations of federal law w/a task force, for example. /2

As I know a legal brief can be hard for folks to get through, even a short one at 23 pages, I thought I put together this thread to explain the central points that we're making in the amicus brief. To file this kind of brief, you ask the judge for leave to do so with a motion./1
Before you get that motion granted, you draft the brief and it's an attachment to the motion. You have to explain in the motion why you want to file the motion and basically what you're bringing to the discussion. Our motion is here: drive.google.com/file/d/1C9uXGX… /2
You also have to explain who the amici is. Amici is latin for friend basically. It's an old legal form for people/organizations that aren't parties to a case to help the judge decide a question/bring a perspective from those who might be affected by the case but aren't in it. /3
