First off, DOJ breaks out the big guns. The Solicitor General argues cases for the United States before the Supreme Court. The message to Sullivan and the court: if you want to take this to SCOTUS, let’s go, we’re ready if you want a 9-0 whupping 
A writ of mandamus should be issued “compelling dismissal” of the Flynn case. Any other course is a violation of the Constitution under Article II / III. Sullivan cannot “assume the role of prosecutor”.
DOJ sure seems to be hinting here that Strzok and Pientka’s notes do not reflect what is written in the “final” FD-302 🤔
Dear Court of Appeals, did you know that everyone involved in interviewing Flynn has now been either fired, or found violating regs, or caught lying under oath themselves or strongly criticized by an Obama-appointed DOJ Inspector General? Just making sure, letting you guys know
Sullivan’s “leave of court” argument rightly goes up in smoke. Rule 48 of FRCP is designed to protect a defendant, not keep a case open when both parties want to dismiss with prejudice, meaning it goes away forever
The “Watergate Prosecutors” and “Scholars” amici both get taken to the woodshed with their ridiculous argument supported by no legal precedent that a guilty plea is a “conviction” and the entire case is “final” (which it isn’t until judgement is entered & appeals exhausted)
Sullivan’s “failure to dismiss the indictment was error.” His “efforts to pursue additional charges of contempt compounded [his] error.” And Sullivan can’t prosecute someone for contempt in a situation like this because that’s the executive’s constitutional role, so back off
The DOJ finally says why Flynn pled guilty at all:
“the record shows that [Flynn] - like other defendants who enter pleas they later seek to withdraw - pleaded guilty with the intent to resolve the allegations against him on the best terms he thought possible at the time.”

Sullivan has “no authority” - zero - to appoint a private prosecutor to go after Flynn for “perjury” or contempt. He “erred in doing anything other than dismissing the indictment.” Sorry Obama, you need a new bat signal this one is busted
The last section destroys the motion that Sullivan/Wilkinson filed today, addressing that Sullivan hasn’t actually ruled on the motion to dismiss yet. Doesn’t matter - a distinction “without a legal difference” because it is “indisputable” Sullivan has “no power” & “no authority”
After reading both DOJs brief & Sullivan’s non-attempt to defend himself I’d be shocked if the writ of mandamus doesn’t issue 3-0. At minimum 2-1
