1/ I'm not a lawyer but I'm a rabbi w/extensive education in legal theory & GenXer with a decent US History education
This was expected from Roberts. He desires the appearance of judiciousness while trampling justice; Zechariah ben Avkulous (#17Tammuz) encyclopedia.com/religion/encyc…
2/ It's possibly based on the same faulty expectation that forced decisions in 2016: that Trump will lose so try to preserve the norms.
In 2016 that meant the FBI would go after Hillary but leave a private citizen alone, despite frightening connections to Russia etc
3/ Comey cared more about protecting the FBI than America. Mueller the same for DOJ. Trees not forest or b/c they conflate their beloved institution with all of America. I.e. if America can't exist w/o FBI or DOJ then those are important in themselves & the ends justify the means
4/ GOP followed this for 20+ yrs & esp. under #MoscowMitch: the GOP is what preserves AMERICA & so everything must be done to keep the GOP in power.
BTW, it's the same rhetoric of the Confederate rebels, that they were the real US & so they would destroy the village to save it.
5/ Roberts has the same view for #SCOTUS, that he will preserve it's importance by establishing it's primacy, yet allowing the GOP to do nearly everything, from the travel ban to today's idiocy
When a Dem is president he will reverse course. He's partisan & a fool
6/ So the same 'Trump will lose so let's save our institution' that animated the FBI in '16 is behind Roberts in '20
Sadly, Comey & Roberts cannot understand or acknowledge that Trump & the current GOP want to destroy America
Act now or it's too late!
7/ They were trying to zig when they should zag, trying to tip the scale to 'judiciousness' & appearing above the law. But sacrificing the law in order to do that
It's wrong to try to zig/zag at all! Judges, FBI/DOJ shouldn't try to wave with the wind. Justice is blind!
8/ This is why judges are enjoined to be completely above reproach. When the justice system - including the police & courts - aims for a goal outside of "equal protection under the law" then the system is dangerous & chaotic
Law preserves peace. No justice, no peace.
9/ I can't expect the GOP to know any of this, sadly. It's a broken party that has led to our time of misery, death, injustice and tyranny
I'm writing these things b/c in a number of years I want to be on record, saying "we knew it at the time"

195.03/ #Eclipse2024 My extended family went to a place of 100% totality and took this picture a few minutes ago. For me its 90% and can't be photographed (which is one reason I said shehechiyanu). Not paskening for anyone else, but for me this is a religious experience.

192.03/ There's a resonance in having a fast that commemorates a community sacrifice for soldiers fighting a defensive war against raging antisemites. #TaanitEsther

191.03/ I agree with Prof. Simkovich, re: the Oscar guy.
Also, I see people wrestling to make sense of his convoluted phrasing, but I'm not inclined to give the benefit of the doubt to a declaration that inherently refuses to give others the same benefit.
