The Constitution says we count PERSONS not "Citizens," but since white nationalists like @realDonaldTrump and his supporters don't think brown people are people, they can't spot the constitutional problem with this order.
I should note that in the original language, the Constitution called for the counting of FREE persons, but, you know, don't tell @mikepompeo about the racist trash this country was founded upon.
In any event, it's CONGRESS that does the apportionment of seats, not the President, so assuming @SpeakerPelosi is still the Speaker of the House she can rip up this executive order much like she did to Trump's State of the Union.
My understanding, and I'm sure this will have to be litigated, is that Commerce (ie, the executive branch) conducts the Census *at the discretion* of Congress. So at the point where Wilbur Ross says "actually only 3 people live in California" Congress can claw back the power.
In the meantime... we're up to 143,000 deaths from Covid and @realDonaldTrump is losing to Biden by 15 points. Every awful thing Trump does is a distraction from some other awful thing he is doing, but this feels like a more desperate attempt to hijack a news cycle than usual.
