1/16. Regrettably it appears that @barstandards has rejected both our analysis and our offer.
Analysis first: Our analysis was that pen and paper exams, whilst they might offer another chance, were ultimately unfair. The less well off you are, and the more employed you are,
the harder it is to find time to take exams. The longer the exams are delayed, the more work is required to repeat revision. We forcefully made the point that delay equalled injustice (as ever). It now appears that what @barstandards were telling us would be September will be/
October and December. Resists will not be until spring 2021.
On the plus side, we persuaded the BSB that everyone should be able to sit. Their initial view depended on an assessment of/
“material impact” for which they had no definition. That
was plainly unfit for purpose - and surprising given that the eventuality should have been known in April.
We also argued for straight pass/fail on the basis that fannying about with marks no one really cares about is/
just further delay. In our view any ATO specifying a
particular mark this year ought to be told to unspecify it. It appears that argument has been rejected too.
The BSB has also conceded an independent inquiry. Before welcoming that, we’d like to see who will be doing the/
enquiring.
Our offer: we offered barrister assessments on the same basis as our assessment of pupils and junior tenants when we teach the compulsory courses mandated by the BSB. The profession would have volunteered to do this. It was quick, welcoming as a concept & cheap. Most/
Unhappily the BAB has spent the 2 weeks since our proposal picking it apart. The alleged problems leading to its rejection were never shared with us, despite the fact that our offer specifically asked that we were informed of issues & given the opportunity to address them./
That approach meant that whatever we proposed could be torpedoed without hearing from us. That isn’t justice & it’s disquieting that a legal regulator would behave in such a way. We were also told the barristers conducting the assessment weren’t able to do so properly./
Perhaps the BSB forgot that the Professional Statement says students must reach the standard of a practising barrister, and that we teach each other all the time?
It is a matter of real regret that the BSB Main Board rejected this proposal. It would have accommodated working/
students at weekends. It would have allowed exams to be done at home on an open book basis, which we believe reflects professional practice in a way that current exams wholly fail to do.
We tried. The circuit leaders unanimously supported our proposal for which we are grateful./
Alas, the same cannot be said about @thebarcouncil, the relevant officers of which supported the BSB on all but a few frilly details.
You will plainly not labour under the illusion that we agree with this decision. We cannot give you legal advice but our view was that the/
proposal arguably breaches the Public Sector Equality Duty. And we are adamant that no vocational profession should come within a mile of such a breach.

Can anything be done by the profession now?/
Short of all out war - ATOs ignoring the defective exams and the Inns determining to call people based on the exams properly run - no. That won’t happen Can anything be done by the students? We know some of you are already ready to litigate. If you succeed, these arrangements/
cannot stand.
We acknowledge the outstanding efforts of @blwstndrdsbrd whose submissions were in our view more cogent & better prepared than either our professional body’s or our regulator’s. Sometimes a good case loses. In a just system you can appeal. Here, all we can do is/
stand with you, invite the profession to do the same, and wish you all luck. It will be no comfort that you have been dreadfully let down. It might be a crumb that we recognise it. Most of all, we’re sorry.

Tolerate difference & dissent. If you disagree it doesn’t mean anyone else is wrong. Disagree on the issues. Point out you’re the vast majority. Critique the approach. But bringing in extraneous issues - gender, conversion, age, religion are a no-no. Some people hate Jews,

@PhilR_R @Mendelpol I deleted my first reply, as I don’t want a personal argument.
The problem of abuse has been going on for at least 10 years. It should not take an article in the paper by somebody who’s not a victim to prompt action.
And it’s a misrepresentation to suggest this is prompt action.
@PhilR_R @Mendelpol For far too long, the community has been deaf to victims. The contrast between the praiseworthy treatment of black members of the community, & the victims of abuse cries out for explanation.
Pretending everything has been done quickly is an abuse of trust.
@PhilR_R @Mendelpol It places organisational reputation over individuals’ suffering. It is precisely what I warned against in the article.
I agree @BoardofDeputies might not be the right organisation. But that doesn’t free it from all responsibility.

A number of key admissions stand out from the leaked report:
1 On any view, the party was mired in antisemitism. When @JVoiceLabour denied that fact, it was lying. How they could be defended by any member of the NEC is extraordinary.
2 The approach to dealing with antisemitism
was, as Panorama said, political. In its rather transparent effort to divert blame, the report makes clear the decision to bypass @JewishLabour was a political one, taken by politicians at the top. It was justified by a “need” to consult the “widest range” of organisations within
the community. That, of course, equates the tiny fraction of acquiescent Jews with the vast majority of the community. That was deliberate.
3 There is an extraordinary reliance on the religion of people making decisions. It appears the authors of the report believe a decision

Advocacy:
About 3 months ago I expressed the sympathy I feel with the need to protect women’s spaces. I received the abuse I expected.
Last night I commented on the need to win those arguments & not behave in a way that alienates support.
The reaction was at odds with the claimed
importance of the issue. When a point needs to be won, good advocates spend as much time on the presentation & wording of it as on the substance.
The reaction of those who claimed I was seeking to endanger women, shut down their concerns, & patronise isn’t just cobblers, but it
undermines the case by making thoroughly bad points.
It also has 2 other effects. First it makes me less anxious to engage. That doesn’t, of course mean I don’t have a view. Just that it’s less likely to be influenced by discussion on Twitter. That’s a lose for any campaigner.

I’ve now had 4 emails inviting me to return to @UKLabour, 3 from organisations that think I ought to help fight to clear out the shit in the stables, and 1 that seems to think Labour won the argument.
Some thoughts: /
This was an abusive relationship. It is something I see professionally. It had a number of the markers of such relationships, particularly the abuse that came the way of anyone who tried to point out the bullying and the unfairness.

love genuinely felt by one party. The other party only wants the public verification, and private servitude. They are never interested in an equal relationship, or a fair one.
Such relationships can occasionally be turned around, but it needs to start with the abuser /

So, at Leeds NE community hustings.
The Tory - suspended for racism - hasn’t turned up.
The meeting is likely to be spicy for @FabianLeedsNE.
There’s a mood of anticipation mixed with depression - you don’t get that right often.
We’re being live streamed on You Tube. We’re hosting @marievanderzyl who is @BoDPres. This is me (ok that’s not very political) but it’s my feed
Apparently the Tory didn’t give a reason for blowing us off.
At a wild guess it’s because he’s been suspended for racism. There are about 50 candidates I know of in this election to whom that should have happened (no one else in this constituency). So props, I suppose.
