Felonious Assault: On 10/4 at approximately 1100 PM, troopers were dispatched to
westbound I-96 near Old Plank Road, Lyon Township to assist Oakland County Sherriff with a traffic crash investigation. Upon arriving it was determined troopers would conduct the investigation.
Preliminary investigation revealed that a male suspect was involved in a single vehicle crash with his truck on I-96 near Old Plank Road. He left his truck and walked up onto the Old Plank Road overpass, which was under construction.
The suspect located several 40 pound sandbags and began throwing them from the overpass in an attempt to strike passing vehicles on the freeway. One sand bag struck a female drivers vehicle, smashing through the windshield.
She was transported to a local hospital with serious injuries. The suspect left the scene and,was picked up by a passerby who drove him home to Brighton. The suspect told the passerby what had occurred earlier. That driver contacted MSP and provided the suspects location.
As troopers processed the area on the overpass, they located several footprints from the same pair of shoes in the sand around the area from which the sandbags were thrown. Upon contacting the suspect, his shoes matched the footprints at the scene and were seized as evidence.
The suspect was interviewed and lodged at the Oakland County Jail. Investigation pends review by the prosecutors office for 1) Felonious Assault Causing Great Bodily Harm and/or Impairment, 2) Damage to private property and 3) Throwing Objects at Motor Vehicle Causing Injury.
The victim was very lucky she wasn’t more seriously hurt or killed. Throwing anything on to the freeway from a overpass or the the embankment can cause serious damage, injuries or death. Don’t do it!
Update: On 10/7, David Garcia, 41 year old male from Brighton was arraigned on one count of Throwing Objects at trains/cars causing serious impairment in the 52-1 District Court. This is a 10 year felony. He was given a $50,000 cash bond. Pends further court proceedings.
