Good morning and welcome to the Genaro Garcia Luna show.
Today's hearing before Judge Cogan starts in about 15 minutes. Will be tweeting live updates to this thread, stay tuned here for updates as things get underway.…
Already problems — lots of people on this conference call, including someone who has a Spanish-language news broadcast blasting. Court interpreter saying she can't hear anything over the background noise. Some people have not figured out how to "mute" yet during the pandemic.
…and we're underway: Michael Robotti, a prosecutor from the Chapo trial, leading things for the government. Cesar de Castro is the lead attorney for Garcia-Luna.
Lots of background noise and people not on mute still, judge's deputy trying to get it sorted out…
GGL now being arraigned on superseding indictment. Judge Cogan upset about the background noise: "I'm hearing Mexican reporters and I don't want to hear it."
Judge Cogan threatening to cancel and postpone hearing if people don't figure out mute: "I'm going to ask the Mexican participants once again to silence your mics, put it on mute."
…and today's GGL hearing has now been cancelled.
Judge Cogan lost patience with people on the conference call line not being on mute and talking in the background.
I will update this thread again when a new hearing date has been set.
Unclear. Seemed like Judge Cogan's deputy may have been trying to mute individual callers and couldn't keep up because too many people were on the line. The U.S. federal courts system isn't exactly cutting edge with its use of technology.
We're still on count 1, which alleges GGL's involvement in 5 cocaine shipments w/ thousands of kilos each.
Counts 2-4 in the new GGL indictment are conspiracy charges related to the alleged cocaine shipments. Count 5 claims he lied to US immigration officials.
Gov also seeking forfeiture, wants to seize money or property obtained from the alleged crimes in the indictment.
GGL's attorney Cesar de Castro says he's reviewed the indictment w/ his client, who understands the charges.
He just entered a plea of "Not Guilty" to all five counts.
GGL's attorney raising concerns about technical difficulties his client has had while trying to review evidence at the MCC federal jail in Brooklyn. Says issue has been resolved but it's still a "tedious" process. Judge urges gov to keep make improvements to the system.
And that's it for today. Judge schedules GGL's next hearing for Dec. 7 at 10:30am ET.
Judge Cogan makes Pearl Harbor reference, calls it: "A date that will live in infamy…"
Resumen en español del caótico proceso judicial de GGL…
“the decision could effectively give border agents a near-unfettered ability to commit violence against non-U.S. citizens, especially those trying to cross the border”
