🚨BREAKING: New USPS data appears to show a failure to deliver mail ballots from voters across the country on Election Day. U.S. District Judge Emmet Sullivan will hold a noon hearing over USPS' non-compliance with his order yesterday to rush deliver all remaining mail ballots
The first column from the left represents inbound ballots, which are ballots sent by voters to elections offices
As of this week, USPS said there were some 300,000 ballots that lacked a delivery scan (USPS Data, 11/2)
Dozens of states had Election Day cutoffs for mail ballot arrival, meaning ballots that were not delivered by close of polls last night will be rejected

(Note: Data below, via @NCSLorg, may not reflect litigation that changed mail ballot due dates)
Update for those wondering about USPS' methodology: Just spoke with @SamSpital, an attorney on the case. He said in all likelihood USPS simply does not know the exact percentage of mail ballots that went undelivered by Election Day deadlines (1/3)
He also cautioned against trying to extrapolate a precise figure based on the USPS processing scores, which reflect the percentage of ballots that arrived within a targeted time frame for delivery (2/3)
Bottom line: As election law experts have said, every election sees some portion of voters disenfranchised because their ballots arrive late, but it is safe to assume the problem has been exacerbated by USPS delays (3/3)
At USPS hearing just now, plaintiffs' atty urges that, going forward, J Sullivan require of USPS the "identification of the number of ballots they're finding, because that's relevant as an accountability measure"
J Sullivan says he also wants more clarity on what he referred to as "the 300,000 ballot issue"
Remember: There are still a number of states that have a relaxed due date for accepting mail ballots that are postmarked by Election Day

Texas, e.g., will accept timely-sent ballots arriving today by 5pm
For this reason, @SamSpital at today's hearing asked J Sullivan to order a sweep of Texas facilities, esp. Houston area, this afternoon so that any lingering ballots "are identified are delivered in a timely way."

USPS sent the following: "The assumption that there are unaccounted ballots within the Postal Service network is inaccurate. These ballots were delivered in advance of the election deadlines. ...(1/4)
...We employed extraordinary measures to deliver ballots directly to local boards of elections. When this occurs, by design, these ballots bypass certain processing operations and do not receive a final scan. Instead, they are expedited directly to the boards of elections (2/4)

BREAKING: USPS fails to meet deadline set by U.S. District Judge Emmet Sullivan to sweep facilities and immediately deliver remaining mail ballots. As of this week, USPS said there were some 300,000 ballots that lacked a delivery scan
USPS: "There are only one or two Inspectors in any one facility, and thus they do not have the ability to personally scour the entire facility. Indeed, doing so would be impractical (given the size of that facility)...
...and would take them away from their other pressing Election Mail- related responsibilities, as detailed above."

Says inspectors will be in the identified facilities "throughout the evening."

But dozens of states have due dates tonight, after which votes are invalidated
