The White House is reviewing a possible major change to the way Social Security evaluates whether someone is disabled reginfo.gov/public/do/eAge…
I got an outline of this proposal earlier this year. Even if your disabilities made it impossible to work 40 hours per week, you could be denied benefits if you could sit at a desk part time huffpost.com/entry/trump-di…
The proposed regulation is still early in the process and there is no way they could finalize it before Biden takes office
The Biden administration can just say "no thanks" to stuff like this. huffpost.com/entry/trump-bi…

McConnell now says set aside the liability shield and also extra money for state and local governments until next year
this would be a grand non-bargain!

unemployment insurance and payroll protection would remain
on the one hand, states have lost much tax revenue because coronavirus is hurting economic activity.

on the other, there is no "tidal wave" of coronavirus lawsuits 🤔

McConnell’s liability proposal would require plaintiffs to prove the defendant willfully exposed them to illness and list all their contacts the 14 days before symptom onset before a trial could start m.huffpost.com/us/entry/us_5f…
Companies could sue people for sending letters interpreted as legal threats over coronavirus exposure and US attorneys could prosecute them
Public Citizen's @ragregg says it would squelch suits like the one against Tyson Foods.

“The procedural hurdles would make it nearly impossible to bring a lawsuit and the substantive changes to the law would create an almost insurmountable difficulties in proving their case."

Democrats have embraced the big compromise framework but Mitch McConnell hasn't
As far as we know McConnell remains fully insistent on blocking lawsuits and has not accepted a weaker version of what he previously proposed
Even after he said there would be a "tidal wave of lawsuits" and there simply hasn't been

Trump didn’t extend unemployment benefits yesterday.

He told states to set up a “lost wages assistance program” in coordination with FEMA, DHS and DOL and it’s gonna be a dang mess

m.huffpost.com/us/entry/us_5f…
It also seems, like, illegal. But a real shame if people think this is going to pay them next week
The memorandum is in plain English and you can see that this is insanely complicated.

Obvious, key context: states have already failed utterly to implement simpler policies in timely fashion. whitehouse.gov/presidential-a…

My guess is state workforce agencies are going to have a hard time with this.

They struggled mightily just to implement laws without having to dive into the couch cushions to pay for it
It seems like this is telling states to construct an entirely new wage replacement program that would operate in tandem with their current unemployment programs? [tugs collar] whitehouse.gov/presidential-a…
States begged and pleaded with Congress not to make them adjust dollar amounts on benefits, saying it would take weeks or months to implement such changes.

Now they’re being asked to create what appears to be a new payment system from scratch.

In 2011. Florida Republicans lead by now-senator Rick Scott endeavored to create the worst, most unresponsive and least generous unemployment insurance system in the country.
